    Hi Pankaj,
    Was your case rejected due to the number of years of education (10+2+3+2 = 17)?

    What if it is 3 + 3 ( 3 year Bsc Physics + 3 Year MCA) 10 + 2+3+3 = 18? I am wondering if USCIS would consider this equivalent to US masters? Came across a memo used by Nebraska Service center that says USCIS would consider 3+3 equivalent to US masters, but that memo was from 2006.

    yes my case rejected due to number of years of education.
    My case they rejected because i have 3 year Bsc and 2 year master now funny thing is that i know my friend who did similar course from same university but he did same master degree like me but in part time so he complete in 3 years and he got approval in 2009.

    As I said before
    "EB3 I and in general all EB applicants need a solution now.
    Until this process becomes so painful for us that we either go back or do a mass movement to get some legislative relief there are no better days for us."
    As current bail out clearly points out that for any change to happen in this country situation has to go extreme.
    So unless....
    when new immigrants stop comming because of GC issues and current immigrant leave enmass
    or
    we do a some big enough show for our needs (not a single rally but something all over the country)
    .....there are no better days for us.


    This is indeed a gloomy and (in my view credible) story. The only thing possibly that can help us within the current laws, is the visa overflow from EB1 and EB2 ROW.

    Lets hope for the best. The Nov. Visa bulletin will be confirmatory.

    Who said the position must be in zone V only to qualify for EB2?

    For the position to be qualified for EB2 it must require MS. For position requirements to be considered "normal", they must fit into the respective zone in terms of SVP level. As I learned from my bitter experience, though offficially for a PERM to be approved the requirements don't have to be "normal" (if they are not, you just need to supply the "business neccessity" letter), it looks like the current PERM's software just doesn't have such possibility "in mind" and automatically denies the application if the total education plus experience requirements exceed the SVP level for the zone corresponding to the position. You will get a denial notice which will blatantly claim something like "By answering YES to question H-12 you have attested that the requirements are normal, but the total SVP level exceeds the normal level for this position..." even if you have answered NO to that damn question! Therefore I don't recommend to exceed "normal" SVP level for the corresponding position code.

    However, if a suitable code falls under zone IV, nobody (except for emplyer himself maybe) can prevent the employer to require, say, MS plus 2 yrs of experience. And it is within "normal" SVP level for zone IV, and it does qualify for EB2 (because it requires MS).

    this poll is a good idea to understand what most of the members expect from CORE. I for one am looking for any updates about (1) new bills being proposed that we can support - calls, faxes etc and (2) any infomation that can help to "predict" whats happening with USCIS efforts to use all visa # (yeah, sorry.. had to use predict and USCIS in same sentence) (3) updates on efforts towards FOIA, country caps remoal, capture of unused #s, .... and anything and everything you can throw at me about immigration...

    but I also understand that most of these lobbying efforts are done in the back ground and its not good idea to share anything in these times. who knows, may be there is an anti-immigrant lurking around (ofcourse paying $$ to become Donor, become senior member whatever) to get inside information. I would rather trust the CORE to do their work and give me directions when they see fit.. like meeting local senators etc..

    transparancy is good as long as it doesn't hurt the cause. I agree with the fact that we pooled $10K in March for FOIA and core gave the game plan and now everyone who contributed wants to know. fine. but you can't expect core to have a goal a month just to get contributions, this is a grass-roots organization and any highly skilled legal immigrant should be able to donate $25 without waiting for updates every week.. I don't think asking updates every week because you contributed $25 or $50 is fair.. just my thoughts..

    What Raj is saying is get your GC first and process your wife's through family based which would take a very loong time...10 years!!!

    Now to my views..Your wife will be able to piggyback on your 485 application irrespective of her status H1-B or H-4 or F-1..She's your wife PERIOD...no problems there!!what i don't understand is this bangwagon "lets apply ours first and include our wife's petition later when PD becomes current"...Instead y not apply both petitions together when PD becomes current again!!Atleast you wouldn't have to worry what if my petition gets approved b4 my PD becomes current!!!And god knows how many years of H1-B extensions they would give you once you have your applied 485 receipt!!!At the end of the day it is your choice!!!

    Which service center processed your I-140 ? For Eb2 cases, USCIS ( especially NSC) doesn't accept a combination of degree and experience. They require a single 4 year degree.

    You should not completely give up on this. Get a good lawyer, a good education evaluator and try to save the case.

    I disagree with logiclife. The Dems had already been in line (even before the elections) with Bush's view of comprehensive immigration reform...they were ready for amnesty for the illegals, whereas Bush's own party wasn't. And this was why CIR was derailed in the House. Please remember that CIR is the only avenue by which legal immigration reform will be acceptable to the Senate, esp. Senators like Specter who is currently Chair of the Senate Judiciary Committee. Of course, at this point in time, it remains to be determined as to who will control the Senate, as VA and MT have not been decided yet.

    My personal view, from Washington, DC, is that immigration will come up in the new 110th Congress. Our work will be done, but IV will need its members support and attention for a while.

    What do you mean "heart, mind, soul, ethics were sold"? How do you know that? Just because someone called the U.S president "his president" does not mean he/she sold anything, let alone someone's soul and ethics. That is their right to call the U.S president his or hers.

    What you said is totally uncalled for. If you are so patriotic, why are you applying for a green card and going by your own words, doesn't that mean you sold your ethics, heart, mind and soul too?

    Are you kidding us? I do not know what level of education you have achieved so far in your life but it looks like you are not enough educated to differentiate between the definitions of permanent residency, citizenship and perhaps working on work visa as far as legal stay in USA by outsider is concerned.

    What would be the "legal" reply from US Supreme court,if you ask US supreme court that whether citizen of other country can call US president a "My president"? . And What would be the "legal" reply from Supreme court of country A,if you ask that whether citizen of country A can call US president a "his/her president"?

    USA expects someone to abide by the land of the law while s/he come to US to work legally. And what is expected legally is one is not involved in "Anti USA" activity whatsoever it may be.USA legally never expects citizen of other country "to love" or "show fidelity" towards USA when s/he is still the citizen of other country.

    PavanV is right in his argument, in a sense, that when some person is citizen of country A at this moment his/her fidelity naturally must be for his/her country A. This is the legally expected human behaviour in every society and country. It would have been perfectly o.k. and "legal" about rsharma's statement if he would have already been US citizen at the time when he stated what he stated.

    Such ridiculous, unnatural, premature, unethical and spineless behaviour can only be shown by the people who are already morally sold.

    First of all when somebody comes here in USA on work visa, s/he has come on invitation from USA base legal employer's willingness and is ethically, legally and morally obligated to provide professional class and quality of work for what s/he is hired. Nothing more or less is legally expected by USA and employment system within USA. USA and its whole society is well aware that these persons are citizen of other countries and so they never expects any kind of fidelity from them at least "legally" and at the same time they even do not grant the rights what US citizen nornmally have. Now out of that bunch many people prefer to go for permanent residency as permanent residency bring little bit stability in living and flexibility in employment and international travel. If one becomes a permanent resident of USA then also USA still only expects that person abide by the law of the land and do not involve in "anti USA" activity. It still does not expect "fidelity" towards USA in legal sense.There is no legal or social or political or any kind of pressure from USA or any governmental or non governmental institutes within USA on any particular person coming from other country to become its citizen. One can stay on permanent residency forever till death(At least based on current prevalent law) and legally work and s/he does not have to become a citizen for working legally. And I do not know about other countries but in India it is not considered "illegal" and/or "unpatriotic" to go in other country(Except Pakistan and Bangladesh) for legal work so coming to USA for legal work whether on work visa or becoming a permanent resident in USA while maintaining Indian citizenship simultaneously is not unpatriotic or illegal. Simultaneously USA's legal system allows an Indian to remain as citizen of India while residing in USA permanently for legal work.

    Now if somebody decides to become a US citizen, there is nothing wrong in that. I do not see anything wrong when rsharma states that "I have decided to become US citizen in future". But if he is mature and human enough then his fidelity at this moment should be towards India (Assuming he is a citizen of India currently) as he is a citizen of India at this moment. Showing this kind of behaviour perhaps may not be a outright unpatriotic in terms of "Indianness" but it certanily signals probable but strong disloyality towards India.

    And I do not think that USA citizens are that naive that they consider the people "not mingled" if citizen of other country do not call USA president a "My president" while holding the citizenship of other country.

    If calling US president a "My President" by non citizens would be the barometer of "mixing" / "mingling" then USA would not be today's USA. So please do not kid USA and us .

    I hope you are wrong about this. I do not see anything on the Approved AP that it should has been used for "humanitarian" purpose. It just mentions that the intention of AP is to allow the AOS applicant to return after temporary travel outside US. Correct me if I'm wrong.

    You are wrong. Read the document completely. it does say humanitarian or public benefit. having said that there are abt half-million people in US who are in AP today.. so i dont think the immigration officers wont harass us so much.. :)

    We can also look at the possibility of mass drive towards bone marrow doner registration, Blood donation drive, Eye donation, etc.
    Also possible is continue with Youtube videos. I think the reason for low response a) laziness b) doing alone may not be exciting and motivating enough.
    Suggestion. We do the youtube videos in groups of three/four. It would be fun activity and will help to build bond amongst IV members.

    I thought Obama administration has practically stopped all kinds of enforcement activities. For example mandating e-verify on all employment. Such a move would not punish the undocumented directly, but only the employers. But Obama administration is filing law suit against States who have mandatory e-verify.

    Undocumented Immigration can be solved within a week. But no politician or anti-immigrant wants to talk about it.

    SIMPLY PUNISH THE EMPLOYERS EMPLOYING UNDOCUMENTED.

    Just put some US citizens who hire undocumented in Jail and then nobody will hire undocumented. All undocumented problem will be solved. But nobody wants to enforce laws on US Citizens. But everyone wants to enforce laws on undocumented because they do not see these undocumented as human beings.

    Instead of deporting 14 million undocumented, and wasting money on this. Just punish 1 thousand US citizens for employing undocumented. I am sure you will see some hidden anti-immigrants being jailed too. The greedy employers promote undocumented immigration by employing them, exploiting them and paying less salary. Why not punish the employers.

    No anti immigration site wants to actively work on this action item. WHY?

    Sorry to hear that. I am just making a point that my attorney told me that if you are on EAD with AC 21 and your 485 is denied for some reason then you are out of status that made me change my mind from using AC21.

    We mailed my wife's PP on the 29th. I spoke to the customer service rep at USCIS and he said post mark date is what they see. But I have been seeing other websites say that its got to be received. Thats doesnt sound logical. So wait and watch I guess.


    it has to reach USCIS by 29th ... those customer reps are so ignorent if you call them today and ask about when is the getting suspended they will say they have no clue.... dont believe them ...it is effective july 2. Sorry to give you the bad news.
