Can anybody answer this question - If an employer decides to port an EB3 case to EB2 for an employee not using the experience gained at the job, does the new EB2 role have to be 50% different from EB3 role?

Thanks ilikekilo for the information. My husband medical coverage will start on the same day of his joining date. There is no waiting period. We need to find out what kind of healthcare plan they are providing and check whether my hospital and OB is under there network.

The way i see it, they've asked for past emp letter with tax forms and some w2s.
None of those would indicate that you were on the bench.
The emp letter should basically just indicate your dates for employment - start/end date, designation, duties and perhaps salary. that's all.

As I see, most of you are missing the point. Instead of trying to understand, you showing the maturity of mind. The whole purpose of EB immigration is to meet the Demand(Job opportunities) vs the supply(immediately available candidates).
When there are a lot of opportunities exists for EB3 level(skilled profession) and less opportunities exists for EB1(Ph.D/Executive Director), USCIS should give more no. of Visas to EB3, then EB1.
A country cannot be built with only the kings, and not even a home can be built with only Ph.Ds(Nobody do the dishes).

My labor was put as just "computer programmer" with my US experience as 4 yrs experience on top of having BE + Masters (From India). My I-140 for EB2 got denied and my company forced it to refile in EB3, which got approved recently.. but then am in the long queue of I-1485.
Initially it was queue for Labor in 2003 which took 2+ years, then I-140 2yrs for getting EB2-denial and then another year for EB3-approval of I-140. Now waiting for I-485 since 2007 July.

We applied for my wife EAD/AP on June 7, 2010 (E-file)
Her EAD was approved in few weeks back but there is nothing on her AP.
Her LUD change was on 6/11/2010 when they issued the receipt.
We called USCIS and initiated SR. Still no change in LUD.
Infopass is not a great option for us (3 hour drive one way). Any help is appriciated.
(We used to have POJ trick for calling NSC IO directly,

We are being told that no undocumented immigrant will get ahead of those in backlog. While the backlog of Family-based petitions has been highly publicized, the petitions of individuals (engineers, scientists, doctors and other professionals) are being left in legal and bureaucratic limbo. About half-a-million highly qualified professionals and their families have put their faith in the legal immigration system and due process of the United States, while working to enhance the US economy. These people have pending petitions either with the Department of Labor, or with the CIS, the final adjudication of which will enable them to work with a US employer, with consequent ripple effect on the US economy.
In the old system, employment-based petitions were limited to 140,000 per year, but the proposed system, �in order to reduce backlog�, reduces them to 90,000 per year only! On the contrary, Family-based cases used to be limited to similar numbers, but now have been increased to 567,000 per year! In addition, close to100,000 of these applicants with pending petitions are being asked to start from scratch in the new system. In effect, it is similar to changing the �rules� or rather, the �Laws� after the fact! Innocent high-skilled prospective immigrants are being penalized due to bureaucratic delay in the DOL.

It is very unfortunate that people equate job opportunities to the population of the country. If that were the case then India and China would have the most job opportunities in the world because they account for one third of the world population but that's not really the case otherwise we all wouldn't be here in the first place.
Opportunities are defined and provided by the economy. When you compare Canada to US, you might say that it's a smaller economy but remember Canada is a G8 country with such a strong economy that most other countries in the world can only dream of. US is the richest country in the world with the strongest economy so obviously other countries don't offer quite the same opportunities but Canada offers things that has become a dream for many of us... to be a citizen of the country where to permanently reside. Canada offers stability, certainty, hope for the future, and and an opportunity for everyone in your family to realilze their dreams as opposed to sitting at home for years doing nothing hoping that one day that EAD will come. Canada respects immigrants and welcomes them with an open arm quite contrary to policies in US where you are allowed to work but your family is not and even you are kept on the state of limbo for years and years wondering what your future holds in years to come. And better yet, you abide by the laws, pay taxes, do everything by the book yet the guy who just walked across the border has much better chances of becoming a permanent resident than you. Where is the respect and fairness for law abiding folks? That my friend is what is different with Canada. You get treated with respect and dignity and you get to decide what your future holds and not the US government.

I hate to burst your "bubble of hope" but Canadian population and job market is limited and the opportunities for professionals like us are limited. Why not consider going back to India and taking up some of the lucrative opportunities in middle management in the IT industry.

Was there a bill to create this category or this was decision taken by the USCIS.
Its a good move, I know that this initiative was started by an Officer from US Army whose interpreter was getting death threats for helping the US. When he saw that it was not an isolated incidence he started lobbying the state department to create a separate category. I have been following that story for a couple of months, but was not aware that a bill was passed to create a new category or visas. (i am sure, that USCIS cannot take a unilateral decision to add more visas or else why would we be begging for recapture bills)

I think that is an Open category and anyone who can show that their life is in danger in their Homeland can apply...For Iraq, since tehre are too many, they may be limiting 5K per year...

In times like these, we should look at the employment generation capabilities of the skilled immigrants. The argument that skilled labor would take US jobs and increase unemployment does not hold as those with 5+ years experience in the US in a skilled position are very likely to start new business, have career in new fields at managerial positions, buy a house, etc which will in itself be a huge stimulus to the economy.
The same cannot be said about unskilled labor though.

When my H1 was pending, I got a 3 month extension based on the receipt notice and a letter from my company. The DMV needs to see your original I-94 which is expiring or expired to ensure that the entry to the country was legal. This was at the Trenton DMV.
BTW, NJ DMV also tries to interpret immigration laws, incorrectly in my opinion. When I and my wife went back to renew again beyond the 3 month period, I was not carrying my H1 approval notice while my wife was carrying her H4 approval notice (longer story, not relevant). The DMV refused to renew her's based on *her* approval notice saying "She is H4 and she is a dependent". We probably need a immigration lawyer with us to get our driver's license now. In the end, I used my EAD along with SSN proof and we both got our licenses renewed. But otherwise the Trenton DMV is very helpful and seem to understand the immigration documents very well. Also if anybody is visiting the Trenton DMV specifically, if you dont have the SSN card with you, the SSN office is a only a short distance away and you can get a printout from the SSN office verifying your SS#. Printed directions courtesy the DMV staff.
I distinctly felt unwelcome in this country having seen other times when renewing a license was not such a hassle. This is the twilight zone for people who are genuine and caught in the immigration whirlpool.
