If both of you are Indian citizens then your only option is PIO as OCI needs atleast one parent to be a US citizen.
If we move back to India on Indian passport and my son continues to hold US passport then he has to leave the country every 180 days or register with police under PIO card scheme. That is a very strange. Children of Indian citizen are at a disadvantage compared to those of a non-Indian citizen even in India.

May be some one who has already renewed their AP can answer this:
I am about to renew my AP. What will be the start date on the new AP. Is it the date after the current AP expires(like with EAD) or the date the renewal application is approved. Appreciate any responses.
I assume, you are asking for "Date of Intended Departure". Please use specific text from the form you are talking about. You can find some answers here (http://immigrationvoice.org/forum/showthread.php?p=256903)

So as per USCIS a total of 600,000 applications were pending until June. We can add another 600,000 for july-aug... total now 1.2 Million
08/14/2007: USCIS I-485 Workload Statistics
The applicants of I-485 are expected to experience delays in obtaining the green card for two factors: One is the visa number cut-off date movement in the Visa Bulletin. The other is the processing delays within the USCIS field offices, including Service Centers. Accordingly, "current" of their visa priority in the Visa Bulletin may not assure them immediate adjudication of their I-485 applications depending on the I-485 workloads and the processing backlogs within the agency.
The following statistics reflect a steady increase in the number of I-485 applications (including family-based and other cases) during the months before the July VB fiasco hit the roof as is shown in the following table:
Month New Receipt Total Pending
June 2007 69,098 597,844
May 2007 68,265 594,706
April 2007 59,266 580,507
March 2007 62,020 572,779
February 2007 45,554 574,783
January 2007 52,082 583,682
December 2006 50,411 588,039
November 2006 53,016 578,805
At this time, it is anybody's guess as to what the figures will look like for the months of July and August 2007 which have yet to be made available. It does not have to be a rocket scientist to figure out a totally different digit in the new receipt numbers and pending numbers for the next two months. These cases will have to be processed and adjudicated generally in the order of receipt in each queue for those cases whose visa numbers will become current in the future. The new statistics for July and August 2007 will add a body temperature to the new I-485 filers with the realization why it would be so important that the political leaders and the Congress should act and pass a legislation to reform employment-based immigration system coming fall. Without such legislation, their journey for immigration will remain intolerably painful.

whome do you want to kill buddy?
I wonder if you ever came across a word called "protection" or "self-defense". If one owns a gun does that mean he intends to kill someone? And I know you are not being funny here (as your name suggests) :)

We me and my husband took infopass on 95th day of reciept date
(11/28/2007). The USCIS officer was not that friendly, but she promised to send an e-mail to main office. The very next day (11/29/2007)we had an update on website that EAD cards were ordered and we got it today. The date on the cards was 11/29/2007. It worked for us. It is really depends on the officer you speak with.

This is absolutely ridiculous! What would Canada want to do with those northern states anyways?
But seriously - this is just random ramblings being lapped up as sensational news in the Russian state media (even if that were true)!

For all those who commented in negative.
1. Its posted in Interesting topics section. GC, E2/E3 predictions,H1B extension etc is not the only thing left in life.
2. Spelling is a logical/creative thing. Its not cramming words from dictionary. Its an art too. Ever heard of phonetics.
have a nice day.
Ofcourse it is our world now. EB community is our world now.
If you want to comment on these kind of articles or post them go to CNN or Washington Post or Newyork Times or Huffington Post. We have lot other media portals.
The main goal of Immigration Voice is to discuss about immigration matters. Its not about silly Spelling BEE or Spelling LEE.
I dont care about that because I have a dictionary, when I write an email I use my word and apparentley when I am talking I dont spell the words :)
There are lot of interesting topics in the world other than Spellings and it is waste of time..

Sorry to hear your story dude. You just met a jerk of a law enforcement official - they are in the minority. Most CBP officers are better than this. Several years ago i too met a jerk like this in an airport in the southeast. I was entering on H1-B, he kept saying that my employer (a reputed american company) was disloyal etc... as he was processing our paperwork. First he grilled my wife, then he started with me, i just responded to him with a disgusted facial expression.. answered his questions rather curtly when asked, did not respond to his rants. His rants were not framed as a question - so i don't have to answer it. All this lasted a total of 5 to 6 minutes as he was checking and stamping our passports.
BTW, not seeing your family for several years is a "humanitarian" cause. Technically the AP is supposed to be used as a travel permit for difficult situations, but most good Americans know that not seeing family for years is a good enough reason. There are jerks everywhere and type A's, thankfully they are not in the majority.
I had similar experience 4 years back, the officer was a A$$$#^%, I answered all his questions, gave EVL (I was working for Fortune 10 company). He kept on grilling me, I asked him to call his supervisor and also offered him to call my lawyer and then he backed off. I noted his name and his ID number etc.
But screwed me big time, he entered wrong I-94 number in his system, after a year when my company applied for extension, the application got RFE for non matching I-94 number etc. Everything went fine(lawyer had to file I-121 for lost I-94, but the extension took about 6 months to get approved.
While the extension process was going on, I with the help from my company lawyer filed a complaint to CBP against the officer and later the officer was transferred (As per my lawyer) to some other desk duty.

This is indeed a gloomy and (in my view credible) story. The only thing possibly that can help us within the current laws, is the visa overflow from EB1 and EB2 ROW.
Lets hope for the rest. The Nov. Visa bulletin will be confirmatory.
You are right...

Did you had the paystubs or the immigration officer did not ask for it?
When you are changing status within the country, they will want to make sure you maintained previous status, so paystubs will most likely be required. An option you may want to consider is visa autorevalidation in Mexico/Canada.
What did you mentioned at line # 30 and # 38 of DS-156?
Remember when a visa is a stamp in the passport, which allows you to enter the country. The i-94 tells you how long you can stay in the country. When you fill in a i-539 it is an Application To Extend/Change Nonimmigrant Status. Not a visa and the reason why you cannot use it to come back into the country
How long was your wife out of status? Please respond. I am unable to get the paystubs from the employer. He is not picking up the phone.
Hope this helps

My employer has made me an account signatory in one of his other company(a sister company of my H1company), so i can take the money out for travel expenses. Is that going to create any problem? I have my regular pay check coming from my H1 company.
I don't want to judge you; but...
This is an example of how people are creating problems for themselves.
Let me guess; you started a company and made it a layer between the h-1b company and your vendor. Your company receives the billings and you withhold xxx dollars so that your employer takes a % on less of a billing rate and then you take it out tax free from your company?
This is one of the reasons why the anti immigrants and people against h-1b believe that wages are being driven down because of the games that people play.
LCA says $60,000. Your billing rate is equal to something like $125K per year but you want to run salary at $60K and take out rest in per diems.
Guess what; per diems and expense reimbursements for those working at staffing companies is not allowed within the law. The only reason your employers even pay you this is becasue if IRS asks they will just make it taxable to you.
In the LCA's that the senators, anti h-1b people look at; it looks like you guys are really getting paid $60k for a position that normally gets paid $100K. Your package may actually be $100K but on paper it is $60k.
If only people followed the law then there wouldn't be much argument at all that h-1b is driving down salaries.
-----------------------------------------------------------
To answer your question; Every time a person opens up an account; the information gets transmitted to Washington and checked against the anti money laundering database. There is now a record related to terrorism related activities. It appears that USCIS has access to it. Whether they analyze it correctly; ie; is it a brokerage account, personal account, company account, etc., I don't know. However, there has been some cases where the only way USCIS could have known about it would have been through the anit money laundering database. If they were able to capture it for a couple of people that I know of; then you can believe that they have it for everyone.
Now; in my personal situation; it was part of my job to be the account signatory on mutual fund bank accounts. I was probably the signatory on 400 different companies but it didn't come up in any USCIS check. This was a long time ago before all these databases were synched up; so things may now have changed.
