After incorporating the company in one of the states. What are the next important things one as a owner of the company needs to take care of especially if it is in IT product development area ( ofcourse including consulting but not purely comparable to predominent desi consultancy services)
Specifically in the following category:
1. If you are selling IT software products and services, what are the legal necessary formalities one needs to take care of?
2. How about expanding the branches in outside USA? May be a branch office in India to leverage huge technical resources? Any legal or other things to be taken care of ?
3. Bank Accounts next steps

Allowing people to file for 485, but not giving any GCs may be the plan.
Such a move do not bring much complaints from anti-immi groups. But this move will reduce the noise from people who have not yet filed for 485s. May be after getting EAD all those people will invest more in America.
This is maximum bang for the immigration buck from the USCIS/DOS point of view.
Ron says it will be current for a "brief" period. (similar to july 2007 fiasco ?)
It will be a good opportunity for people waiting to file 485. For people already in the queue, it may not make that much difference.

Please go and take some english writting classes first. Your english is very poor. Taking some classes will help you in longterm. MBA in US is taught in english not telgu. An MBA from a shady univ is not going to help you anyway and USCIS is cracking down hard on bogus porting these days.

The reason I suggested sending in our credentials is beacuse the key in reverse brain drain is also "brain" along with "drain".
If we send in our credentials wrapped along with a stopper it will show them what they are going to loose.
Even to hard core right wingers it will show them that even if they neglect the human factor they cannot neglect the intellectual factor..

They have their cause and we respect them like we should respect every other human being. We simply should not be lumped in with their cause, because we are opposites, and because that has been what has affected us so much)

I have sold some items in eBay in the past, If I rememver correctly, when I sold something for $10 and the buyer made a paypal payment, paypal too $1.5 as fees.
So if you are making $20, only $17 goes to IV, IF the amount is >=50 I believe the fees is much lesser (like 5%) so more money goes to IV instead of making paypal rich.
How about check? 100% goes to IV.

This would be the last visa bulletin for this year. The dates should move just like they did last year to consume all numbers.
For September they can do anything for consuming leftover visas, including a large unsustainanble forward move, but we hope that visas are used for preadjudicated cases in PD sequence (as is described in USCIS procedure manual). However, from October on it appears that dates will only move forward systematically. Reason is that USCIS systems are not designed for handling per country quotas well, which hinders any country quota based information until a file has been opened for adjudication (or preadjudication). There is no per country data readily available on entirely pending cases (except on your paper filings), as initial data entry does not include chargeable country name. However, as we have recently noticed, a lot of cases are getting preadjudicated, which makes chargeable country information available. This should help USCIS estimate monthly demand better.
Bottomline is, if all three of the following conditions are true for you, you should expect good results in coming months.
(1) Your case has no hickups, you have provided all necessary documentation.

Hello, here are few practical things you can do right away:
1. Call your embassy.
2. Ask to speak with a Legal Attache / Equivalent
3. Explain the case in your native language.
4. Ask for help. Most foreign embassies are setup to help.
Tell them you are helpless. Dont know where to go. Given them 100% facts. Dont feel shy about the 'gory' details.
Remember, this is in the legal system now. Bulletin board responses from here are not as good as solid legal advice and help.
Next, find a local Chinese / Asian community organization. Google for it. If you cant find one locally, search for ones in big cities like NY, Boston etc and ask them for a reference. These groups are setup to help immigrants in distress. You might find an Asian-friendly or Asian lawyer willing to take up your case, FOR FREE. Just ask.
Finally, stop talking to all your neighbors. You can always reserve the right to file a Civil Rights / Discrimination suit. The American Civil Liberties Union (ACLU) can help. Call them. After you call your embassy.
This can be resolved easily if you have the right people on your side. Got it?

I don't know what's the logic behind the processing dates. How could all the dates move back so much? It does not make any sense. I wonder if we could contact someone regarding this or maybe, USCIS wants to minimize the number of queries and moved the dates back so fewer people call and ask for status?? I have no idea what's behind it.....

May I add, these posts are very much relevant here as these kids are immigrants and their kids. They might become an entrepreneur or scientist in the future and it shows the value of the skilled immigrants.

Why are we discussing this subject when it will do nothing to take us closer to getting the GC? In almost each social event, I have heard this subject being talked by my fellow friends. But discussing it on IV forum does not serve much purpose.
To me, it seems in the conversations about this subject (not just this thread, even in social events), each person is trying to find a group of people that agree to his or her thoughts. That makes the group then feel better. But what do we all do the next day, pray that we get the GC fast. People who want to really go back to their country do not take much part in these discussions. They just pack up and go.
If we are spending any time on IV, it should be focussed on our effort to get the GC. Or to help someone of us facing an immigration related issue.

for reply.... as I said I am on EAD.....
assuming you are serious about the house ..I can say this ..with your PD and category it makes more sense to rent a house for a year and then decide yourself.
with a house you get lot of space, independence but with significantly high costs, maintenance and loss of mobility. plus you end up buying far away from your work ..so family time is lost during weekdays.
in apartments - you end up saving and investing more in retirement accounts, children education accounts etc etc ..but the flexibility is priceless...also greater chance of your kids making more friends in apartment parks / play dates etc.
so renting a house is a good bet if you really really need space ....home prices will decline for many more months in most locations and will be stagnant for years when u take inflation into account ..

-if i have rfe send in paperwork from present employer which will only be a generic letter----(i don't know how much detail uscis likes)
-the reason i want to do LOA is that this way i will be sure they will not revoke i -140
-what do the gurus feel ?

I think your plan may work out just fine. I would make a couple of suggestions:
1. If you are taking LOA from original employer, for practical purposes (for USCIS), you are not employed with that employer any more (they go by pay stubs). But if doing so helps to avoid revocation of 140, go ahead and do it that way.
2. Because you will actually get your pay check from new employer, you are employed by them (and you will work on EAD with them, make sure that this is mentioned on your I-9 form). No matter how much ignorant your employer is, they will have to have I-9 on file and it must have your EAD (not H1).
3. After doing this, you will be on I 485 pending status (no longer on H status), and so make sure you have current EAD and AP all the time.
4. If something goes wrong with your I 485 (very unlikely); you will have to leave the country and enter back on H visa and work for H visa sponsoring employer (probably your old employer).
5. It is perfectly fine to not file AC21. AC21 is needed only if you do not plan to join original sponsoring employer after GC approval. However, if you do want to file AC21, you do not need much documentation from your new employer. It just needs the simple letter stating your job position as a "physician" and brief job duties (briefer the better!) and salary (should be proportional or higher). If you do not file AC21, you may just keep that documentation on file with your attorney (which I would do to be on safe side). The implication of having this is as follows:
--If you have this documentation (even if not filed with USCIS), at the time of approval of your GC you will have the option of just staying with new employer or going back to original employer.
--If you do not have this, you will have to go back to original employer after GC approval with a "good faith intention of permanent job".

Was there a bill to create this category or this was decision taken by the USCIS.
Its a good move, I know that this initiative was started by an Officer from US Army whose interpreter was getting death threats for helping the US. When he saw that it was not an isolated incidence he started lobbying the state department to create a separate category. I have been following that story for a couple of months, but was not aware that a bill was passed to create a new category or visas. (i am sure, that USCIS cannot take a unilateral decision to add more visas or else why would we be begging for recapture bills)
Whcih categories do Political Asylees or Refugees get into?
I think that is an Open category and anyone who can show that their life is in danger in their Homeland can apply...For Iraq, since tehre are too many, they may be limiting 5K per year...

Letter writing will be useless. USCIS wont give without a fight. You have to see from their point of view. This open a can of worms for them. They will never yield unless forced by court.
I think USCIS is not the one who decides not to use wasted visas. It should be Department of State. As per my understanding USCIS "returns" unused visas back to DOS.
