Since your situation is aggravated, your wife can apply for F1 visa and come here. How you want to answer visa questions on DS-156 or date your marriage cert is upto you. But all said and done and whatever the morale police on this board have recommended is not really valid because you will be going through all of this and not these people who are giving other suggestions. I really want to ask all these people who say dont backdate marriage cert or dont get her on F1, are you guys angels and have done nothing wrong in your lives or are you just preaching others not to sin?
I think you may have missed the point. The people who were advising the OP weren't necessarily thinking of themselves as angles or as the moral(!e) police, as you politely put it. ;) They may have additional information about a similar situation and maybe trying to help him make the right decision. If you know somebody who tried to backdate a Marriage certificate and got wrongfooted by the Consulate maybe you would try and advise future applicants to be a bit more careful too. Or maybe not. Anyway, not saying that's the case here, but there maybe more to the replies than you think.

As far as I know, Fiancee visa is only for Fiancee of Citizens, not for GC folks.

To he who handed over $7K.....
If you have good documentation of this... then there are some fees that employers are not allowed to pass on to employee (either in part or in whole).
These include things like H1B processing fees.
They might include labor certification fees (required for GC).
Now unless the 50% specifically identifies which fees, I would take it to mean 50% of all. If your were charged for 50% of something that it is illegal to charge for then Department of Labor may pursue both on your behalf and in the public interest. By pursue, I mean get your money back (or some of it) and fine or worse to employer.
So find out what documents you have and where your local dept of labor is, and go and pay the friendly staff a visit.
I know someone that was done out of a few thousand in unpaid overtime. They got his money back for him, even though he only went to them years after, but he had pay slips showing hours worked and money paid. They handled it all for him.

I will look into my folders and see what all proof I have in order to defend myself...I know the fact that all my emails communications and shared documents, payslips are still in place and will for sure find something out of it...

This discussion should scare many many people. I can count so many people just over the top of my head who would have a similar problem.
This discussion scared me now.
I came in US on 06/03/2001. When I came I was told, no project for me right now and I have to wait. I waited till 09/11/2001 WITHOUT pay.
The first time I was on my company payroll was in 09/11/2001. Since then as of today I am working continously.

Folks, can dependent's participate in writing letters to President? I have already mailed my hand written letter to White House and copy to IV team, in addition to that I got confirmation from other Indians with whom I work also mailed their letters..If dependents are also allowed then count for another 10 letters from my side...;)

My PD is Aug 2005. My employer by mistake sent the 485 application on June 27 and USCIS received on June 28. Today Aug 21, I received the rejected 485 full package back. Employer is following up whether it can sent back. Anybody has any idea of any luck in this case, or has to wait till dates are current again?:mad:

According to the AILA, approximately 40,000 visas remain in all employment-based categories, other than EW, for FY2007, according to its sources, and that the USCIS has far more than 40,000 adjustment applications in the backlog queue that are ready for approval, not to mention the additional numbers which will be consumed in concular immigrant visa processing. It is thus possible that the cap may reach within a short period in July, even though no one can predict it until after July 2, 2007. The USCIS at this time does not have any policy announced with reference to July 2007 I-485 filings which are filed after certain date in July when the total number is exhausted. However, considering the fact that the USCIS currently rejects the "Other Worker" category I-485 applications even though June 2007 Visa Bulletin show current for certain applicants because the "other worker" category quota was exhausted on June 5, 2007. This raises a serious concern because as we reported earlier today, the USCIS appears to be picking up the speed of processing of backlog I-485 applications in anticipation of flood of July 485 applications. The USCIS hands may be tied, should the EB visa numbers for FY 2007 is exhausted before the end of July.
The situation is particularly critical because of the USCIS decision not to accept the I-485 filings without the medical report. AILA demanded leniency but the USCIS reportely refused to accept such demand. Since medical report is "initial evidence" to I-485 filing, under the recent rule change, any I-485 filing with the medical report can be rejected or denied. Reports indicate that there are a huge backlog in scheduling medical examination in most of the areas in the country.

As you say that the illegal immigrant lobby gets hundreds of thousands of dollars per month. Do you think any illegal immigrant is contributing this money. They work for minimum wages and have hardly any money to spare.
I think most of the money comes from businesses that employ these people to cut costs.
Yes true, the hispanic groups is also about 50 million in size. I'm sure these businesses are breaking some law in funding, besides employment.
There are large organizations that support our cause too, especially IT. They played a big part in positive H1 reform. Not sure if they were approached or they work independently.
It looks like were averaging $0.05 per IV member though.
I find it hard to believe we don't have 2000 H-1s willing to contribute $25 a month
do people expect 40-50 persons to fund IV for campaigns that can benefit 45,000 members, as they watch from the sidelines?
Another point I think is that even if IV had a couple of million dollars I don't think it will be able to pursuade the Congress to pass any legislation to bring relief to legal immigrants .
I will defer that to core group & Donor Forum, but IV has acheived a lot of things as posted earlier, part of it through active lobby groups and political experts.

I am the primary applicant. I am planning to get married in next 1 year or so with a girl from India. If I get my GC then she will fall under family based which will take years for her to come here. I do not mind moving back if that happens.

There is no reason for you to pull out your 485. Get your divorce expedited and get married quickly and you should be OK as EB3 India is not really moving forward unless there is a visa recapture or something like that.
Your spouse will of course lose her 485 and will have to start afresh. But I assume she already knows this and is OK with that.

We might be looking at it the wrong way. The question is whether outsourcing is bad. Maybe thats not what the question should be. My view is that just like competition, outsourcing and globalization are facts of life. You can fight it, but it will not get you anywhere.

When I think of outsourcing, I think of just another competition for your job. In some cases though when the entire department is being outsourced you are part of the herd. The same can be said for entire departments laid off.
