Obviously i was wanting to know what the law states...and not a democratic answer. I dont always expect forums to quote the law correctly - use your judgement!
Thanks anyway for that answer. My situation is different beacuse with the I-140 PP going away for now...and my H1B expiring Feb 2008...I am left with approved I-140,Labor and retrogressed dates to be eligible for 3yr extension.
Now that if 140 is pending ...then I am left with EAD as the only option to continue manitaing my status.
Correct my intrepretation of law if wrong..
If your labor was filed after Feb 07 (since your H1 expiring in feb 08) and your I-140 does not get approved by feb 08, then EAD is the only option to be in status, (unless u join Patni, TCS, wipro, Infy on L1 :-)

Everyone on the fence and still deciding to send flowers, please do it. Here's why I sent it even though I was opposed to this initially. This is a chance to get USCIS attention. If it works, I dont want to regret that I didn't take part in this. If it doesn't work whats a few bucks when we are spending lot of money on the processing.

I personally don't think any dramatic change will occur by december. You should probably follow your lawyer. This is a reasonable guess based on warnings issued in the November bulletin and assuming that even if any positive legislation is passed there will not be any movement in December bulletin - such movement would occur only later.

This was the same guy who said FOIA can be hung on wall like an art frame because he does not need the data. He does not care a rat's ass if you care about the data or not. When I mentioned that FOIA can also be used for making a presentation to the lawmakers on how deep the retrogression is, FOIA is ok and good. Because, it will possibly benefit him

I-140 is approved. I-485 was filed in July 2007. I have an opportunity to move to another company for a similar job profile. But the new company wants me to work as a contractor (hourly) on W2.
Is that a problem when filing AC-21?

Hello there,
I have been wanting to make an IV contribution for a long time and here is my problem..I probably can be labeled a miseror a magpie! ..Whenever I go to the IV link to contribute and see the $50 or $100 option I panic and get out..yes I do!
I have some desi colleagues and was discussing this issue with them at work..and they had the exact same experience..wow..I am not the only magpie..
But hey is'nt IV the one which is at the receiving end not getting our contributions..
I speak from my own experience and call me a mapie or a miser..or whatever..I cant make myself make a $50 or more contribution .. thats the way I am..But I can sure make a smaller contribution (like a monthly recurring $10 contribution which really is easier to make) and I am quite sure IV will benefit from my small contributions as well as i think a lot more people will not hesitate making contributions in smaller denominations than a whopper $50+
And really this is not related to IV effort but more to do with my own way of thinking about parting with my money..I love my money..:)...

As of May 2007, USCIS reported a staggering 329,160 FBI name check cases pending, with approximately 64 percent (211,341) of those cases pending more than 90 days and approximately 32 percent (106,738) pending more than one year.

This is wrong. EAD can be issued when both of the following conditions MUST meet:
I140 has been approved
I485 application is 180 days old
UTTER NONSENSE
You become eligible to file for the EAD/AP THE day you become eligible for AND actually file for I-485.
HOWEVER your 180 day calendar Begins ONLY WHEN Your I-140 has been approved AND your I-485 application has been pending for 180 days. That after 180 such days can you change ur job and ur application for Permanent Residency is NO longer dependant on the employer through whom you filed your GC.
Guys PLEASE do not give advice authoritatively unless you know what you are talking about.

A recent post asking about how many people have EB2-India PDs of 2003 or earlier had no responses, so I am curious about the potential spread of waiting people (atleast in the sample set of whoever responds to this poll).
RESPOND ONLY IF YOU ARE EB2 INDIA, HAVE FILED 485, AND ARE WAITING FOR APPROVAL.
(we can do separate polls for EB3-I, china, ROW etc)

You are trying to defend a criminal and thus some people objected to it. Crimes by immigrants, whatever they maybe bring bad repute to their country and the immigrant community.
Dude, that is called as stereo-typing and we need to fight that. You can not control few immigrants who commit crimes. That is law enforcement and judiciary's role. Why should other immigrants be discriminated because of few bad apples.
