When my H1 was pending, I got a 3 month extension based on the receipt notice and a letter from my company. The DMV needs to see your original I-94 which is expiring or expired to ensure that the entry to the country was legal. This was at the Trenton DMV.
BTW, NJ DMV also tries to interpret immigration laws, incorrectly in my opinion. When I and my wife went back to renew again beyond the 3 month period, I was not carrying my H1 approval notice while my wife was carrying her H4 approval notice (longer story, not relevant). The DMV refused to renew her's based on *her* approval notice saying "She is H4 and she is a dependent". We probably need a immigration lawyer with us to get our driver's license now. In the end, I used my EAD along with SSN proof and we both got our licenses renewed. But otherwise the Trenton DMV is very helpful and seem to understand the immigration documents very well. Also if anybody is visiting the Trenton DMV specifically, if you dont have the SSN card with you, the SSN office is a only a short distance away and you can get a printout from the SSN office verifying your SS#. Yesterday, I was told by the client that my project is going to end by this month end i.e Apr 30. Actually it was supposed to go for the next 2 years. I am currently in the project working for the project. They said the lay off was becoz of budget issues. But I see I am the only one that is target in this lay-off. I am working with the same client for the past 3 years. The lay off news was really shocking and devastating.
I am currently 9 months pregnant. As the client did that to me, I thought that atleast I might have some options with my current employer. My employer is a desi consultancy. I never been on Bench for single day for the Past 6 years ( Day 1 that I entered into US to till now).

We paid all the attorney fees and filing fees from our pocket. We spent nearly $10,000 for the GC process. My husband was on bench for the past 2 months. 1. I see that my employer is terminating me immediately because he can avoid maternity expenses. I told him that I will take 3 months FMLA for unpaid maternity leave from Apr 30th. And look for the Job immediately after delivery and get into the Job. But still he is telling he won't provide me that time. Maintaining the status is very important for me as me and my husband depends on the EAD.
2.My medical insurance is with my employer, If I get laid off in this critical situation, I won't be having insurance. We can't afford the delivery expenses without insurance.
3. Even though my husband will get insurance with the new company, We are not sure that company will cover the pre-existing pregnancy that is in final stages.
4. And also not sure that the insurance will be under the network of OBG/YN and the hospital I registered for delivery. His job is in different state but he will find out the options once he starts his job next week.
5. Does anyone think that my employer is discriminating the law? He is terminating me immediately becoz I am pregnant.
I am not sure whether he is doing the right thing but the situation I am in is the worst situation I ever expected of. Its lot of stress on me and my baby. We are unable to sleep for hour with all the tensions ahead. My husband's job is dependent on my valid status. If something screw up we both be in very bad situation. Given that you got your 140 approved and applied for 485 and it is more than 180 days, you are in relatively safe situation.
Rememeber GC is for future employment, as soon as the dust settles..you need to find a job!

As many of you are well aware, it has been about 50 days since IV was started. Since then, we have come a long way in setting up a platform to voice our concerns. We also established an able alliance with QGA to have a powerful channel for our voices to be heard on the hill.
It is now game time!!
Two very significant legislative vehicles, namely the PACE bill and Comprehensive immigration bill are right on the corner. PACE is scheduled for discussion end of Feb, and the comprehensive Immigration bill beginning of March. In this dynamic legislative climate, it if very difficult to predict which of these potential vehicles could bear fruit, or even predict the timeframes accurately. IV�s strategy is to pursue both the bills and push for our goals to be on them.
We are in immediate need of funds for that very purpose. We are seriously low on gas right now, for the journey ahead that we are only just starting on. We have only raised $30,000 in the last 50 days; even more alarming, fund raising has gone down drastically in the last 2 weeks. At our current burn rate, we will be out of money in a month or so, just when we expect the bills to come up for discussion on the Senate floors. As you can expect and appreciate, there is a cost for achieving anything politically. IV has already demonstrated a great deal of leadership and persistence to work on retrogression relief and labor backlog elimination. Many IV members will start making trips to DC in the coming weeks to meet lawmakers at the hill. We need your help NOW!

There is one more option for you. H1 and L1 employees can go on long paid/unpaid leaves. If her company can support with document that she was on an unpaid leave for any reason (I do not know the reasons...make something) then there are chances that she will be able to change her status back to H4. All you have to prove that there was a good faith employee employer relationship for that particular duration. Talk to a lawyer, explain the situation..........every passing day is making your situation worse. Good Luck.

Like the other guy you said, I have an equity of 200,000 in one house and 50,000 in other house. I still don't have green card. I have around 300,000 in
401k and 150,000 in brokerage accounts. My net worth is around 800k, most of my money is in this country. If I want to continue my lifestyle, I need my GC, that will secure my right to live in this country. AFter 9 years of tax paying and law abiding life, I think i have a right to live in this country, but with this stupid laws don't know when i will get my GC.

The following are various ways to express some one�s dissatisfaction/agony and draw some one else (Government/Media/Public) attention.
1. Daily Fasting : One or more people would sit for fasting from 6 AM to 6 PM. One group would pass on the fire to next group.
2. Continuous Fasting : One or more people would sit for fasting 24 hours a day. Such people should not have health issues like Blood Pressure, Gastric Trouble, Sugar, insulin deficiency, Heart relates issues. This may cuase arrest.
3. Protesting : Conduct a rally with group/mass of people with immigration ply cards and banners.
4. Wearing Black Ribbons : People would wear/put a small black ribbon on their shirt pockets (Upper left side of the chest) and attend duties. We can draw people attentions. Such ribbon should have white color immigration slogan printed on it.
5. Distributing Flyers : Distributing Flyers/Handouts to people in respective areas.
6. Banners : Display banner/show outs in the Traffic Island Medians
7. Flower Campaign : Sending Flowers to respective people, also called Gandhi giri.
8. Silent Sitting : Sitting in front of USCIS silently (no talk).
9. Silent sitting in front of Senators house: Group of people should sit (kind of protest) in front of respective state senators. We can draw maximum MEDIA attention.
10. Sweeping Roads : A group of people would sweep roads by wearing immigration slogans jackets.
11. Organize Blood Donate Drives : Interested member would donate blood (We should explain to media, why we are doing so).
12. Rally in All Major Cities : Conduct a rally in all Major cities (where we have at least 100 members) at the same time.
We still have various other ways to express our dissatisfaction, however, they are little rude and could cause more issues.

I think we should start a Employer Hall of shame and nominate employers who are either cheating the employees or the Immigration system.

Following the rules as they are doesn't imply there's no injustice or congress can just shut shop and go home. Giving unused visas from EB1 to EB2 is just following rules as they are - just as giving preference to Non-Indian's first is. I get to meet plenty of EB1 & EB2s who are just plain retards so its not 'obvious' that they're going to 'benefit' the greater society at large though the rules were framed hoping that would be the case. Also, EB3s def. have to be labor certfied so they're not displacing anyone - the whole system is such a mess and is being abused so much that things that ought to be obvious & taken granted for have to be reiterated again & again so its just dumb to say 'EB3 is the least qualified of the three and is also the most likely candidate to displace an American'! And if theres a sudden glut in the labor force and plenty of native born well qualified work force is available, there shouldnt be anyone in the GC queue to begin with so there'd be no reason to do away with any quotas - unless one presumes people will be abusing the system all the time.
