My point is if we check our credentials, how many of us are 'true' innovators? I know I am not, I am an expert in what I do and am an asset to my company but I haven't filed any patents or publications which would be the true requirement for this country. My skills are indeed readily available in domestic workers as well. Could that be the reason for the backlog in EB-3 and none in EB-1? So do we need to do a reality check here? Just wondering if this could be the reason why we're getting a raw deal. Could it be that 'highly skilled' is not enough but 'genius' and 'highly skilled' is what's required here? Just a thought.

Facts: I had to set his browser's proxy multiple times so that he could connect to the internet. He does not have 1% of the skills he claims and the word is out that he will be laid off next week. The point is , cases such as these make our presence here viable.
I have more examples of such geniuses I have seen over past 10 years.
It is not a secret that all of us are not innovators.However one must accept that there is a shortage of people who can run these operations.In my professional life , I have not seen a skilled American unemployed. Financial reasons may force a business to lay off a good worker. However, if you are good , you get a job instantly.
I am lucky to be working at a place where your skills are more important than your nationality.

There has been established a way to deal with backlogs at Dallas and Philly, and these officials at PBEC and DBEC have been given a deadline of Sept 2007 to clear everything. So someting is and will be done in this regard. Not much more can be done here with PBEC or DBEC, and the real test is to get solutions for the retrogression.
Once the laws are passed on the immigration reforms, its a done deal my friend, and then it does not matter how much we try after this to address retrogression. This is our only chance.

Despite making several valid points, USCIS is merely delaying the inevitable and, in effect, increasing the cost to the agency to process these cases. The cost to complete the current backlog of over 800,000 I-130 petitions is more than $225 million today, based on USCIS� cost estimates explained in its proposed fee rule. Because applicants paid for these petitions when they were submitted in previous years, their payments do not cover today�s costs or future USCIS costs to process them. There are favorable indications from the industry that they will get increased H1Bs. There is hence a strong belief among many lawyers that the H1B lobby will provide some relief. But we need to meet lawmakers so that they don't forget about the Green cards.
If you live in NY state, please contact bottlemani or myself. We need to organize ourselves before meeting the lawmakers. We will also have to take the trouble to drive to their offices. If we don't do this, all these pessimistic predictions will come true. Believe me, meeting the folks in the offices of the lawmakers makes a huge difference.

It is sad to see that only few people have signed up for state chapters. there are very few on your NY thread even though we have several members from NYC and NY state. We all need to change our attitude and help each other in this common cause. If we all think that someone/others will do it for us, then nobody will do anything and we will all continue to wait for our greencards for the next several years. IV is providing everyone an opportuity and tools to help and work. IV core is working overtime to get it done. We cannot succeed if we do not get support from each and every member.

Check ICICI. I think it is called a NRE account. You can fund it in Dollars and Rupees and it could be repatriated in Dollars. So just open the account and have them deposit the monies India, you can draw it here. This kind of account is for NRI's who earn an income in India and want to access it here.
There is a limit I think but it must be like $25K..

If I were planning to use my EAD now or in the near future I would just cough up $380 and apply for a fresh EAD instead of chasing USCIS.
If it works, then it is money well spent compared to running back and forth to USCIS offices, calling them daily and all the painful aggravation involved.
I will gladly spend 380 instead of risking the possiblity of picking up Diabetes or Blood pressure due to stress.
Is it possible to do so ? Can we apply for 2nd EAD application even without first one, and having got the receipt notice for first one ? If yes then this is a good solution, but then who knows how long the 2nd one will take to be approved, making it a worthless effort.

We are all highly skilled immigration applicants who are stuck in limbo, some for more than 8 years, despite being fully legal, tax paying and highly skilled.
Since the number of highly skilled legal immigrants is so small (less than a million) compared to the number of illegal immigrants (12 million) it is very difficult to get our voices heard about the problems caused by waiting in a seemingly endless queue. The issues, unlike those of illegals, are largely non-controversial, some as simple as asking USCIS to reduce our waiting time from 8+ years to a year.
Since we are all highly skilled in areas where there is a shortage of US available labor and provide a disproportionately large benefit to the US economy, we believe that approving our already filed applications on an expedited basis could be helpful to all of us.
Currently, a bill that is under consideration by Congress called the SKIL bill will solve almost all of these non-controversial issues.
I and my fellow members would much appreciate it if you could run a story on us, and/or direct us to a source that helps publicize our organization.

I guess country quota is root of all our green card related griefs. everybody else can dream of getting a green card someday, but EB-3/EB-2 India & China should stop dreaming about Green cards...I am sure this can be prooved illegal.

I am applying for AP (new). Are they issued with 1 year validity or 2 years ( now that EAD is being given for 2 years)?
I recently applied for my renewal (AP & EAD) - got my AP approved in less than 3 weeks (which is good processing time).
Validity was for one year, only and from the date the previous AP expired.
EAD - Still waiting - it's 47th day, today and counting. Hopefully before I hit the 60 day mark...that seems to be the processing time, these days.
