I have a question on my wife' AP renewal
My wife would like travel to India and come back in November or Dec 2008.she would like to leave on August Last week
Any way we would like appy for renewal of AP , the current which expires on Oct 30 2008.
Let us say if we apply for AP Renewal July 2- or July 3 , the new AP may come before her Journey date Augut 2008 , OR It may not come before her Journey date Augut 2008 .
Since her current AP expires on Oct 30 2008 , Does she need to come back to USA before Oct 30 2008 ? or can we mail extended AP to India , if she is travelling back after Oct 30 in November or December
please advise us , accordingly we will make travel plans

From what I can gather, from the immigration perspective:
1. If you are on H1 - You can technically start a business but since you cannot "work" towards it, in practice it's almost impossible
2. If you are on H1 and have an EAD - You can start a business. But if you use your EAD, you are no longer on H1. (There are contradicting views on using EAD for PT while still maintaining H1. For now, this is a grey area)
3. If you are on EAD -
a. If you plan to work on your business on a part time basis and stay with your sponsored job full time, I don't see a problem with this.
b. If you plan to work on your business full time, you might have an issue with a RFE at the I-485 stage as you would have used AC21 for self employment (Some people say this is okay, but it depends on your risk taking ability)

It's simple.. Find some one in your friend circle who wants to send money to india and tell him that you will transfer rupees to his bank account in india and ask him to transfer dollars to ur account here.

No. This was the recommended workaround by a parents group that intended to file a PIL at one point. I will be able to try this next year though. I will send out the letter above too.

AND ONE MORE THING. THESE PROCESSING DATES ARE FOR RENEWAL APPLICATIONS. NOT FOR NEW APPLICATIONS. FROM MY EXPERIENCE I SAW FIRST TIME FILERS ARE GETTING THEM IMMEDIATELY THAN RENEWALS WHICH WERE TAKING 2-3 MONTHS.

If you had received a denial of your application for example not having the same designation/ different salary/different location etc... please contact and we would like to assist. I always loved this board for what it does - especially the Gurus who always spend their precious time giving input to member's queries. Well... this is not query. I just want to vent my frustration, helplessness to fellow friends in this board. In spite of graduating from a reputed univ with a Masters and very good GPA and also having 7 years of professional experience, I am bound to be a slave to my current Employer without any promotions, career growth or anything remote to that for next (God knows how many Decades) several years. ppl who are junior to me in every aspect are growing left and right and are also getting brighter opportunities. I dont care if you guys think I am jealous of them.... But does God really exist ? sorry for wasting your time with this depressing note. Take a look at option from Colorado State Univ Distance Education website. They have a MS(course option), where you need 10 courses to obtain a MS. Each course approx. costs around $1600. So, you are looking at a total of ~17k.
They will also waive GRE requirements if you give evidence of your experience in the industry which looks like is not a problem.
The degree certificate they give you is no different from the certificate one would obtain if one was to attend school full-time and complete the same MS course plan.
Some courses could be completed in summer as well. So, if you can take 4+2+4 over one year during spring-summer-fall semester you could be done in 1 year. I am assuming you don't care about grades, and hence taking 4 courses should be manageable to just get a pass grade.

I have worked with a company on h1b from 1st jul to 12 nov in 2007 on h1b visa. They did not pay me for last 45 working days. My employer is telling about the following clause in in my offer letter:
SALARY: You will be paid an amount equal to a 70% basis of your bill rate based on the understanding that you will work with us for a period of at least one year. If you leave Company before completing 1 year of employment your compensation will be adjusted to a $55,000 per year basis and the excess amount paid to you will be deducted from the last two months of your salary.
Please let me know whether this is legal to have this kinda clause in offer letter. Is there any way to get my salary?
