Does it mean they would stop processing I140 premium applications which have already been sent. My I140 was pending for 6 months and I changed it for premium after the dates became current, it was sent by my lawyer this Monday (25th) and received by USCIS on 26th. Does this mean it will not be processed or does this mean they will not accept any premium processing applications from July 2nd.

as per the law u can switch employers after 180 days from recipt of ur 485 application...unless the CBP wants to give u a hard time...he should not jerk u around on that....

We are being squeezed all along the way... Did you notice I140 retrogression? Think about those who got stuck at labor, then 140, then I485, then name check...
Did you hear that they were trying to eliminate AC21? So what's the benefit of filing I485 considering all the backlogs? Without AC21, you still have to start all over again should you lose your job.
Pure stupidity on those bueracrats!

I am in the same boat and my employer has decided that they will revoke I-140 no matter what. Can you tell me how did you find out that your employer revoked your I-140. Maybe he/they did not. But my firm is really big and they go by the rules. So I just want to know whenever employer sends the revocation, does USCIS always revoke or it is upto their discretion whether or not to revoke. Problem is I do not have a job yet so I cannot even file for AC21.

I am in a similar situation. I applied for my first LC based on Skilled employee (Category 3) because my first job financial analyst only required a bechelor degree even though I have a masters degree then I filed for the I-140 (priority date May 2005). then I got a promotion to a senior financial analyst which requires a masters degree. so I automatically could apply file a second LC to file under (category 2 which is current). however my cecond LC was denied because the DOL thinks that there is no difference between the 1 job (financial analyst) and the second job (senior financial analyst) with the same company. so I checked with my lawyer and he said that I can file for appeal so the DOL will review their decision and realize that it was wrong. I did file for appeal in Sep 2006 and I ve been waiting since then. does anybody know or have any idea how long the appeal normally takes so they can make a decision on my case?? please advise. Thank you

I received USCIS email today saying My I485 is denied . ( I have not received the letter yet). I did sow LUD on my I 140 last week.
I have switched employer after 7 months of 140 aproval. I also sent AC21 letters .
I do not know whether my previous employer revoked the I140 . ( it never changed the status from approved)
For those who got 485 deniel letter , did you see any LUD in I140 just before that ?

As if things weren't enough complex, today my friend told me one more thing about finger prints. His PD is 2004 Sep EB2, so he called USCIS to know the status of his application. Then they told him that his finger prints got expired (as per them they expire after every 15 months). So they will invoke the notice to get him an appointment for finger prints. They also mentioned if finger prints have expired then they can't process the application unless it gets renewed.
Although this is first hand information, I was very surprised and not sure whether or not to believe the information given by USCIS call center.
The information that my attorney gave me was on similar lines. From what she told me its a good sign that I got my biometric appointment for next month when my PD is current. You never know, its USCIS.

I filed an apeal for my first PERM too and preparing to file another one (through another company - you can't file another PERM via the same company while your first PERM is in appeal). Your's is there for longer than mine. I heard 4 to 6 months would be the time. Please let us know when and how yours is resolved.

Shouldn't one believe in each and every one of these things for the fear that they might be true since no one can really disprove their existence? Again it comes down to probability. The probability of there being a God is very close to zero, thus making belief in God untenable.
