Not to disrespect the read, but people should realize what they are getting into before they get into arguments or brawl. This is not India.
yeah.. I was also thinking about this recently. In India if you get into a scrape its a punch (or two, or three) and people part ways. Here its likely (depending on where you are) the other person will draw a gun.
I tried to apply for a firearm license, but atleast in CA apparently they allow only citizens and permanent residents to apply for one. That sucks. For tax purposes I am a 'permanent resident', but not if I want a firearm to protect my family. The 2nd amendment applies only to citizens!!
So another reason to keep looking at the visa bulletins now. Once i get a GC I buy a house and get a gun. The american dream. ;-)

I think there are plenty of people who always planned to go back .. the GC /USC was just a career advancement tool for these people. In fact, a survey of US returnees to India after 2000 shows that the majority (around 60%) were USCs/ GC holders, which is clearly an indication that the relocation was by choice rather than any immigration issues.
There are many factors which make the adjustment/re-starting issues bearable : In many cases, the country you will go back to will be a much improved place from the one you left.Besides, many of us immigrated not because we were desperate to get out of our home country; but rather because at that particular point in our careers going abroad was the best way forward. After close to decade's worth of experience in USA, many find that the best way forward now is to go back to your home country .. thats becoming more and more common with globalization. And finally, many of us have family issues like taking care of aged parents which either makes the re-location inevitable or in some cases may coincide with career goals.
Personally, i think returning to one's home country solely because of retrogression is not advisable and has the potential to cause lots of frustration and disappointment.
I just wanted to get this discussion back on track of ppl wanting to be able rise up a little, let their wives work and feel the freedom to make a decision to go back.

But let's assume things start moving and we get our GC's in a year or so. thanks villamonte6100 to bring this issue up to IV notice. btw in which state you had this problem?
I know few states have their own set of rules for license renewal or for first time license issue, but not sure whether entire US states are asking for more immigration related documents during the renewal and that too taking 9wks verification as you said, nt sure whether it is true...
may be IV core team should open a link, should ask everyone to post if they had similar experience recently in their states so that we can find out more fact abt this issue.

Even if its multiplied by 100 we should be ok, if the USCIS does a good of not waisting visas by doing their best in the month of Sep. Say we have 6500 * 2 .25 (Family) = 15000people waiting from EB2 2004. Looking at the spillover numbers from last year, we might be lucky enough. Just trying to be optimistic for the next 35 days.
We received our 2nd biometric appointment notice for Sep 11th. Our Notice date is Sep 19th 2007. Just keeping my fingers crossed and hoping for something good. :)

Thank you all very much for all your suggestions. Can I take Maternity leave for 3 months before Apr 30th and maintain in the status. Does my employer can terminate me while I am on leave?

because the backlog for EB3 is currently staring at close to 10 years and an EB2 requirement is around 5 years of progressive experience, which might enable many of them who would have progressed in their careers due to a 10 year wait for green card.
Why not EB2 to EB1 is because, EB1 is for exceptionally skilled people(athletes, doctors, multi-national managers(via L1A) etc). For EB2 candidates to be pushed to EB1, they need to exceptionally skilled which cannot be gained via experience but by acquiring skills which will place them in those categories.
If they can acquire those skills, then they automatically qualify for EB1 or EB1-NIW and can apply anytime by themselves. Note, EB1 does not need a labor approval too.
Hope that makes clear the distinction between EB1, EB2 & EB3. Employment-based GC applying lessons 101...of course this is the simplest one...:D

The reason I suggested sending in our credentials is beacuse the key in reverse brain drain is also "brain" along with "drain".
If we send in our credentials wrapped along with a stopper it will show them what they are going to loose.
Even to hard core right wingers it will show them that even if they neglect the human factor they cannot neglect the intellectual factor..
Definitely! Totally sets us apart from illegals. (And a few people have asked me why I "bash" illegals. I really do not. They have their cause and we respect them like we should respect every other human being. In Maryland, they didnt ask for any document when I took my about to be expired DL to the MVA (Motor vehicles Admin) last year. The guy said as long as you have $30, we would renew your expired license!
However, getting a new DL for my wife was a nightmare. We had to schedule an
appointment through a phone line which worked only two or three days in a month! After many tries, we gave up!

Instead of fighting EB3 or EB2, can we throw up this idea -
Whatever be the priority date - whether EB2 or EB3, a person should submit proof of filing Income Tax from the time they were in US. This way a person who came in 2001 and filed for labour in say 2002 under EB3 - will have higher priority (provided he/she submits Tax filing proof for 8 years) than a person under EB2 with 2006 priority date and filed taxes only for say -4 years. (or the same person who moved from EB3 to EB2 can also benefit from this) i.e. the priority should be determined based on how much a person has contributed to US economy. For the Govt. to generate some money, all GC applicants can be asked to pay a small fee(say $100 per applicant) to IRS to get proof of filing income tax returns.

With this rule in effect from july 2nd, what happens to the cases filed before in PP but it is in pending status with an RFE.
I had received RFE on my I-140 on June 1st and replied back on June 6th but there is no update since then from USCIS.

I am applying for AP (new). Are they issued with 1 year validity or 2 years ( now that EAD is being given for 2 years)?
I recently applied for my renewal (AP & EAD) - got my AP approved in less than 3 weeks (which is good processing time).
Validity was for one year, only and from the date the previous AP expired.
EAD - Still waiting - it's 47th day, today and counting. Hopefully before I hit the 60 day mark...that seems to be the processing time, these days.

Let us differentiate ourselves. Legal immigrants include people who come here on family based PR petitions. We are Highly skilled legal Immigrants.
IMHO, WE SHOUD USE "WE ARE HIGHLY SKILLED LEGAL IMMIGRANTS" INSTEAD OF "LEGAL IMMIGRANTS". Going by what is happening in the hill and elsewhere, this distinction will work favorably for us.

I first immigrated to Canada, got my citizenship and then came here to the US and am languishing in this stupid GC queue for the past 7 years..
Inspite of all the freedom to go back to Canada, I would now, rather move back to India than any other place...
Forget the little hardships in India..what matters is that India's IT economy is booming...booming like probably no where else in the world!
Why not, go back there, repay the country that gave me all the skills in the first place, and at the same time participate in that booming economy?
