I filed an apeal for my first PERM too and preparing to file another one (through another company - you can't file another PERM via the same company while your first PERM is in appeal). Your's is there for longer than mine. I heard 4 to 6 months would be the time. Please let us know when and how yours is resolved.

Please know that both H.R. 5882 and H.R. 5921 are under review by the House Committee on the Judiciary. However, no companion bills have been introduced in the United States Senate. Same case was with me. They picked on my 3 year bachelor degree. Can i do appeal after 2 years ?
Not appeal but rather re-filing as a fresh 140. The labor doesn't expire as long as you had filed an i-140 in the past when the labor was valid.

Thanks for all the inputs. I still have not received the letter ( probably because of winter strom - delay with traffic) .
Now if the Deniel is because of AC21 and 140 revoke , when we reply with MTR, should I sent copy of the AC21 letter we sent before or do we need to sent a fresh one ( employment verification letter ) ? The reason I ask this is when we originaly filed AC21 docs ( in Feb 2008) I was with Company2 . Now I am with company 3 ( just 2 months ). And good part of is company3 is well aware about the "same or similar " letter and is ready to issue the letter .

Its better to send as much documentation as possible in a systematic way. What I did with my friend's appeal was I created a document in a tabular format with each row referring to the points mentioned in the denial notice and providing a brief explanation and referring each point to an Appendix which contained detail explanation and corresponding evidence/documentation (W2, pay-stubs, exp letters etc) supporting the explanation. You can do the same. Infact, I encourage you to provide evidence of your AC21 filing with Company1 which affirms that you indeed followed the AC21 guidelines from your perspective. Do also provide evidence of continued employment in same or similar occupation till your most recent/current employment.
One more thing you should keep in mind is the deadline for filing the appeal. No matter when you receive the denial notice, usually, you only have 33 days from the denial date to file the appeal. So, I would encourage you to do whatever possible from your side to know the reason/s for denial so you can start working on collecting the appropriate paperwork for the appeal. Maybe taking an InfoPass appointment might help. I am not sure of any other options.

my NY dl is valid until 2009, but in red letters it says "Temporary resident until" showing my H-1 date of expiry, which of course expires every year.
I called DMV, and she said although you should change it to reflect your new H-1 expiration date, it will still work if you have your H-1 renewal papers (so in your case your EAD dcouments) with you. should probably be sufficient to keep a copy in your car. and this is only if you get stopped by a police car, or are travelling by air.

I have a question regarding an appeal I did a year ago for a rejected LC.
I have an approved LC and I-140 on an entry level position (EB3) with my company. after I got a promotion to a senior position that requires a masters degree but with a smilar job description but more senior and supervisory responsabilities with the same company. after promotion, I filed for a new LC (EB2) but it got rejected because DOL thinks it is the same position as the already approved LC. my company and I wrote a letter as an appeal on Sep 2006 within 30 days from rejection of LC to BALCA explaining that new position requires a masters degree and it is a senior position with more supervisory duties. as of today, almost a year later, we haven't heard anything regarding DOL (BALCA) decision on my appeal. is anybody in the same situation?? what should I do next?? also I read somewhere that DOl might revoke the already approved LC EB3 after I filed a second LC for EB2 with the same employer. can DOL revoke the first LC EB3 after I have an approved I-140?? please help. Folks I had an infopass this morning for EAD pending more than 90 days. The officer basically told me cannot issue EAD but will contact NSC to check status and gave a customer information receipt saying "Our records indicate that your I765 is pending. I will contact NSC for further review of your application"
I was very disappointed by this. Is there anything else I can do to get interim EAD? I still don't see a LUD on my case.

Guys -
Dont lose "Hope". Its the most audacious word. I left the country in May 2009 with frustration , anger and the fact that whenever I was finding a contract in that tough times peoples were even NOT interviewing me the moment they heard that I'm a "H". They dont want to hear if I have EAD or my GC is going on - PERIOD. The vendors and contacts who loved me ( because they ripped high billing from me in 2000-2009) even started ignoring me.
I felt harassed that i'm fighting on a "non-level" playing field. Eventually I got something at CA (I live at MA) for 55/hour and on the other hand I got a top notch salary offer from a US born Hardware company's Offshore office at Bangalore, India. They SHIPPED all jobs from US to India. I took that offer because I have my Old parents there at India and missed their company for 9+ yrs ( apart from regular vacations).
However I could not adjust with several things there and ran back here after 10 months and found a truly EB2 job and ported my EB3 Mar 2005 Priority Date to EB2 in less than 1 year - I'm CURRENT ( YAAAYY !!) and Waiting for GC to come any day....
By the way - I'm not M.S from US or any kind of masters degree holder from anywhere. I have a strong B.E degree from one of the Top 10 engineering colleges of India (not I.I.T though) and 11+ yrs US experience and 12+ yrs total IT experience in my kitty.
Nothing is impossible - Wish Best of Luck to all EB3 India guys , you have the ability to turn the game , just play it truthfully and play it smart.

if its BS+2 yrs..u shud be producing Exp letters for 2 years...
