I am currently working for company X on L1B visa, my visa is valid till Sep 2009 and My I94 is valid till Apr 2010. I was in India in April 2008 and I had applied for a H1B visa via company Y (in US) in April 2008 and my petition got selected and approved in the lottery and I am eligible to get it stamped from 1st October 2008.
I have been on L1 2 times for about 1 year duration each time.
My questions are:
1. Since I was out of US during the H1B application filing, my H1B will only be valid when I get it stamped by US consulate in Canada? (I had specified that as my port of entry to US knowing that I will be in US at that point of time)
2. Can I continue to work for company X based on my L1 till I get my H1B stamped, which I plan to get done by Dec 08?
3. At the US consulate, at the time of stamping if they reject my H1B application would my existing L1 be still valid or they cancel that also?

Recently got Laid off. Here are my details:
-485 has been pending >180 days
-PD: Feb 2006
-Last day of work is 6th March, 2009
-EAD valid for another 6 months or so.
-I am working on H1-B, which is valid till 2010.
I understand that I can use AC21 and work on my EAD as long as the job is similar or same. I also understand that it is a good idea to get the H1-B transferred rather than using the EAD.

Depends on timing for RFE and approval time. At the time of RFE and I-485 approval, beneficiary should have permanent job offer that matches with LC Job duties. Technically, one can be unemployed during AOS stage, as long as he/she has permanent job offer that begins after I-485 approval.
-Do I have to inform USCIS that I am unemployed as of March 6th, 2009 in case I do not find a job?
There is no such regulation at this time.

For people who want to file I-485 filing on their own. Since 485 filing requires only one document from the employer (Employer's letter saying you have the job and its the same job description), its possible to file 485 by oneself without additional help from lawyer or employer. This is a thread for that purpose. Even those who have the help and attention of a good lawyer can use this thread for guidance. This is the initial list of documents that are required for 485 filing and the optional EAD and AP filing. The fee structure is scheduled to change after July 30th. The fees listed below are applicable now thru July 29th.
I-485 DOCUMENT CHECKLIST
1. Payment Checks (USCIS Filing Fees $325.00 in favor of 'United States Citizenship and Immigration Service' OR 'USCIS').

The movement of the EB-2 visa numbers for Indians is indeed a very good news in that it sounds that the USCIS intends to take out the visa numbers for them before the end of September 2008 as best as they can and attempt to adjudicate the applications before the new fiscal year starts on October 1, 2008. Obviously, there must be a large number of EB-2 cases which were filed during the July 2007 Visa Bulletin fiasco whose priority date is June 1, 2006 or earlier date. It appears that the USCIS has been working hard to get these cases ready for adjudication while their visa numbers are availalbe so that the agency prevents the visa number for FY 2008 from being wasted. We thought the same way 3 years ago, 2 years ago, and last year too, but nothing happened, it could be another year and we could be sitting here in same situation 2 years from now. Question is when IV has already collected money for FOIA request than why it is not proceeding in that direction ? We get it in time or not is not the question now.... Its too late. I am sure in coming 15 months whole immigration system will be changed. May be we will see point based system or something different. And at that time information will be no use.

I am doing Kelley Direct and would definitely recommend it. The Professors are great and course work feels like your regular full-time load with assignments, quizzes, mid-terms and finals, project works, case discussions and some weekly classes. Most of the professors are very interactive and you can always call them. The teaching faculty is top-quality with some of them having Ph.d's from MIT's and Stanford's. Marketing is considered top-notch at Kelley. Curriculum allows some flexibility and course load can be completed in 2 to 4 year period requiring 1week compulsory on-campus presence in 1st and 2nd year. If you have time, you can also participate in 3 to 4 week clinics for 1.5 credit hours in summers. It is now costing me around $975/credit hour with 48 credits required to graduate. Add to this cost of books at other administration/technology fee which might add upto $5k to $8k.
I have couple of friends who graduated from Thunderbird too. It is top-notch for International Business but doesnot allow the flexibility to complete at your own pace. My friends were totally tied up with work and course-load for 2 years. It requires somewhere between 51 to 54 credit hours to graduate. It has two compulsory International workshop clinics each in 1st and 2nd year for a period of 3 to 4 weeks. This is partly paid from the fee, while you need to pay for flight tickets and meals. I think the books are included in the $57k+ tuition for this program.
Kelley full-time is ranked between 18 and 23 depending on which source you would like to use. Its Marketing Discipline is in top10. Thunderbird is not ranked in TOP50 but it's INTERNATIONAL BUSINESS discipline is ranked number one.

Therefore, pursuant to Section 202(a)(5) of the Act, the unused numbers have been made available to China and India Second preference applicants. Since Section 203(e)(1) of the Act requires that such unused numbers be made available strictly in priority date order, the China and India applicants have been subject to the identical cut-off date. I understand your concern. But $5000 was just number put by me as target.. I am sure we need more then that.. I feel if we put some target then people contribute and try to achieve it. But core member never said we just need $5000. So please don't stick with that number.. That number was just target that I thought we could meet. If you ask core members they going to say that we need more then that. As you know everything needs money.. Core is putting their time and mmoney and doing this all for everybody.. At least we can do is act on their action items.

I am surprised that this thread is still active. Usually by this time somebody from the core group puts a statement and that usually closes the discussion. Yes this is correct. If you have an approved I-140 and your I-485 is pending for 180 days, the employer cannot revoke your I-140 unless there is fraud in getting the I-140. If you have done joint filing of the two, if you get your I-140 within 6 months of the joint filing, you can change employers immediately after that. Of course, you can't just go to any employer; it has a to be a similar job.

Hi,
I am on H1B visa for the past 2.5 years and my current visa expires on 30th Sept 2010. When i approached my company for visa extension, i was told that based on management decision they are changing my visa from H1 to L1. I have a question on this one. If i proceed with this process and in the mean time i get a job offer from different company in US that is ready for H1 transfer and extension, Is it valid? Can i continue to work on my H1 for remaining years? If this is not a valid case and i need to continue with L1 only (with current employer), Will my number of years to work in US be reduced?
Please treat these questions as urgent ones and kindly reply.

But as soon as he talks about his senseless economic plans, Investors pull their money out from the Market. Investors don't see a direction with Obama w.r.t solving this mess. Lack of investor confidence has a direct impact on the main street as companies will have to cut their Opex due to shortage of investment. Government can cut capital gains , lower down the taxes and bring more people to invest in the stock market.
If Obama goes by and spends all that money on government bull crap programs, it will not help private enterprise which in turn won't help in job growth or recovery. With no jobs and less consumer spending, economy will go into further hole with a huge debt.
That has been tried for the past 8 years and all it did was create this mess.
Oh yeah, the private enterprises are hiring people left and right. :rolleyes:You must be from alternate universe or wathcing too much faux news.
