    HI,

    My wife got her h1 approval in Oct 2007. She hasnt been on any project, nor has she received any stubs. i want her to convert to h4 again as she is pregnant. If she goes to India to get her H4 stamped what docs does she need? will there be any problems?

    My EAD receive date is 27th July and notice date is 31st Aug. I made two infopass appointments till now but got different excuses both the times for EAD not being approved. During my first appointment, local office told me that since USCIS is counting 90 days from the notice date, i should come after Nov. 30th. I went there again on Dec 3rd. That day local office told me that NSC is currently processing july 3rd cases and you do not fall outside processing period window. So you need to wait.

    I called USCIS customer service center several times. But everytime i get some different reason for not opening up a SR. I guess now i will wait until NSC start processing july 27th EAD cases. I am sure once that will happen, USCIS officers will give me some other excuse rather than looking into the case.

    Thanks you all for the responses and help. We are searching for employers who can help me out in the situation. Most of them are thinking twice bcoz I am pregnant and have to take maternity leave within a 2- 3 weeks.

    Which will be the good option for me in this situation H1 transfer or EAD? I have EAD in hand, but never used. I like to maintain the status of H1-B as long as time permits. My husband is going to get health information next week once he joined in the job.

    It is safer to be on EAD when you are without job. You don't have to be working on EAD as long as you have a valid job offer at the time of I485 adjudication as GC is for a future job.

    Even on H1B ,taking leave without pay during pregnancy does not cause you any status issue.

    Guys ! I know couple months ago a lot of us got RFE's and the status says " response received and cased resumed" but nothing after that , do you'll think that they might look into our files even with different PD dates.


    I received RFE and later after submission of requested documents, the satus is now 'recieved and case resumed". Is it possible to know if a case is pre-adjudicated?

    Agree with Gary. And update us on the results.

    Folks I wish your suggestions would be helpful, but I have taken 3 infopass appointments, and to my badluck, everytime I visit I meet the same old-fat-lady who now happens to remember me, and says, "Didnt I tell you last time that blah blah blah ", believe me, she was not willing to even accept request to send interim ead , she gave some reason that NSC outsourced callcenter work to contractors who dont know what they are saying and send us to local office to request interim EAD. She says my FP for ead was done only in Nov(my 2nd infopass resulted in 2nd FP) so it will take 4-6 weeks after that to get EAD. Anyways I will take your advice for a 4th infopass next week.

    Theoratically what you say is correct. Once the revised bulletin came out people are not supposed to file / send out mails in this matter. However, what the AILF is going to fight is the "revised bulletin". They are going to fight that uscis cannot publish a revised bulletin at such a short notice and if they (AILF) wins, this revised bulletin is nullified and July will become open to every one with LC, right??

    Not quite but your first part was right. AILF is focussing on the revised bulletin but from immigration-law and AILF documents it seems they are focussing on getting some visa number for July. Opening it for all will not going to work and judge will not allow. But it's too early to interpret. Please hold on before AILF clarifies or file the lawsuit.

    Thanks for the info. I went and pulled up the 9089 filing and just saw that the filing date was 15th may 2006, the expiry date was 3/31/2008 and hence i might have incorrectly assumed that the filing date was 2 years before that.

    I would strongly suggest, people refrain from using words like injustice, etc., Injustice implies the US govt is doing something wrong, when they are not. Such accusations do not reflect well on us and are unlikely to benefit in any meaningful way.

    Desis are impacted because we are just so many of us. No other reason. Keep in mind that we are still walking away with the bulk of green cards each year, far above the stipulated Quota.

    The Green card system exists for the benefit of America. It will not be tailored to meet the individual needs of overpopulated countries. All we can do is request them to improve the system and make it easier for applicants. Taking the aggressive approach of accusations, demanding for change, asking for more, etc., will not work.

    Are you kidding us? I do not know what level of education you have achieved so far in your life but it looks like you are not enough educated to differentiate between the definitions of permanent residency, citizenship and perhaps working on work visa as far as legal stay in USA by outsider is concerned.

    What would be the "legal" reply from US Supreme court,if you ask US supreme court that whether citizen of other country can call US president a "My president"? . And What would be the "legal" reply from Supreme court of country A,if you ask that whether citizen of country A can call US president a "his/her president"?

    USA expects someone to abide by the land of the law while s/he come to US to work legally. And what is expected legally is one is not involved in "Anti USA" activity whatsoever it may be.USA legally never expects citizen of other country "to love" or "show fidelity" towards USA when s/he is still the citizen of other country.

    PavanV is right in his argument, in a sense, that when some person is citizen of country A at this moment his/her fidelity naturally must be for his/her country A. This is the legally expected human behaviour in every society and country. It would have been perfectly o.k. and "legal" about rsharma's statement if he would have already been US citizen at the time when he stated what he stated.

    Such ridiculous, unnatural, premature, unethical and spineless behaviour can only be shown by the people who are already morally sold.

    First of all when somebody comes here in USA on work visa, s/he has come on invitation from USA base legal employer's willingness and is ethically, legally and morally obligated to provide professional class and quality of work for what s/he is hired. Nothing more or less is legally expected by USA and employment system within USA. USA and its whole society is well aware that these persons are citizen of other countries and so they never expects any kind of fidelity from them at least "legally" and at the same time they even do not grant the rights what US citizen nornmally have. Now out of that bunch many people prefer to go for permanent residency as permanent residency bring little bit stability in living and flexibility in employment and international travel. If one becomes a permanent resident of USA then also USA still only expects that person abide by the law of the land and do not involve in "anti USA" activity. It still does not expect "fidelity" towards USA in legal sense.There is no legal or social or political or any kind of pressure from USA or any governmental or non governmental institutes within USA on any particular person coming from other country to become its citizen. One can stay on permanent residency forever till death(At least based on current prevalent law) and legally work and s/he does not have to become a citizen for working legally. And I do not know about other countries but in India it is not considered "illegal" and/or "unpatriotic" to go in other country(Except Pakistan and Bangladesh) for legal work so coming to USA for legal work whether on work visa or becoming a permanent resident in USA while maintaining Indian citizenship simultaneously is not unpatriotic or illegal. Simultaneously USA's legal system allows an Indian to remain as citizen of India while residing in USA permanently for legal work.

    Now if somebody decides to become a US citizen, there is nothing wrong in that. I do not see anything wrong when rsharma states that "I have decided to become US citizen in future". But if he is mature and human enough then his fidelity at this moment should be towards India (Assuming he is a citizen of India currently) as he is a citizen of India at this moment. Showing this kind of behaviour perhaps may not be a outright unpatriotic in terms of "Indianness" but it certanily signals probable but strong disloyality towards India.

    And I do not think that USA citizens are that naive that they consider the people "not mingled" if citizen of other country do not call USA president a "My president" while holding the citizenship of other country.

    If calling US president a "My President" by non citizens would be the barometer of "mixing" / "mingling" then USA would not be today's USA. So please do not kid USA and us .

    Who's is kidding whom? I am educated enough to spot a hypocrite like you. It does not take education or the knowledge of law but some common sense to think about these things, which you don't have. Also, a hypocrital bully like you does not have any morality or ethics anyways. Look yourself in the mirror before you call names or judge somebody. I don't need a lecture from a person like you, especially on the law or the meaning of citizenship, which I am quite aware. So, just keep rambling about your useless crap.

    What do you mean by upgrade to premium? I dont think you can change the option by simply upgrading. You need to file I-864 to change to consular processing.

    There are a few options:

    1. If you have chosen consular processing, ( I am guessing you have not), you can file I-485 and amended I-140 at any time PD becomes current.

    2. If you chose AOS on I-140 and the I-140 is approved, some consulates accept attorney certified I-140 provided you pay the fees usually payable to NVC. Expect 3 months of delay in getting an appointment though.

    Pros & Cons:

    Consular:
    You get your GC as against EADs endless loop.
    You have to be with the same employer for atleast 180 days since the time you get your GC and you enter US using your GC.

    AOS:
    You and your spouse both get EAD. NO need to travel to foreign country.
    You need to wait 180 days from filing 485 to change jobs (assuming 140 is approved, if not the case is more complicated).
    More time consuming and longer duration.

    The lawyers here will vouch for I-485 as it means more revenue for them. If you have a stable job where you are doing good and you are counting to get a promotion, etc go for consular processing instead of getting stuck with 485 process.


    Can someone please advice pros and cons, keeping in mind the forward movement of priority dates could be just for the month of June!

    My 140 is still pending in NSC I have the option to quicky upgrade that to premium and then go for CP, what would be the course of action?

    Also what are the wait times for CP in Mumbai India?

    yes, its an equally plausible statement; however I was only referring to the way USCIS handled the July 2007 fiasco applications. There will always be bit of exceptions here and there. As people have pointed out also, there might be reasons for those exceptions as well. They have various stages in processing a 485 application, so it'll not always be FIFO. There'll be a bit of overlap always.

    I was impressed by the way they published the processing dates accurately. Through that, I knew the approximate time-frame they were going to pickup my application. I also could guess reasonably well the time-frame for the RFE hence. I acted goody goody at work during those days then ;)...I knew I will have to request an EVL during this time-period that should match my job duties in the application.

    Dude, i think you are thinking too much of it. USCIS is NOT an organization that goes by process.

    No intention of harm or personal flame... i just wanted to show how a statement of exactly opposite nature can also sound equally plausible.

    Hello Everyone,

    I am back again. This forum is outstanding when it comes to reliable information....

    I work for a reputed US Consulting firm. They under-pay you and make you over work. They market fake resumes in a polished way. YES... IT is TRUE. Don't just blame the desi consultants.

    I am on a EAD. I wanted to switch to hourly basis and wanted to see if there are any direct vendors who would be ready to pay better rates. Desi Consulting Co. is out of question. From my experience, Robert Half is bad too. Is there a better way to market yourself..to the employer?

    Any help will be appreciated. !!

    I think Immigration Voice should stop this stupidity of catering to a community that cannot split $20 per month.

    I think most members feel that things were going great without immigration voice when we were dis-organized, without any lobbying power and without an professional help.

    I think most members are hoping that lawmakers will take pity on them at some point in time, and start working on their own so really why waste $20. How much stuff can $20 buy? Why waste it on Immigration Voice. Why not take your wife to a movie for $20. That's money well spent.

    IV Core: Stop asking for funds and get back on with your life. Dont you have a life, a family, a job? Dont you worry about your own jobs when you divert attention from your daytime job to this stupid website and activities? Why they heck do you keep travelling to DC when you are not even having support of 1000 paid contributors?

    Just go and leave this community at the mercy of Chuck Grassley and Jeff Sessions.
