This was discussed earlier. Jaime proposed it and lot were interested in doing in it..may be this is the right time for us revisit it.
It works this way.. Each of us need to send their local senators a stopper and a personalized memo saying 'tax paying legal immigrant since year <ur year of entry>..no green card because of country cap limit and visa number wastage each year by USCIS..We would want congress to pass a legislature to recapture the unused visa numbers. We are NOT asking for H1 increase.. The reverse migration is already in progress and might become severe without any congressional inaction.'
This could work because we have atleast 2000 active members and there are around 100 senators. If each of members could send a stopper(cost around 10 dollars each) to two senators, each of the senators would receive forty to fifty stoppers. It will atleast gain us the much needed Media publicity.
The problem with us is most of the members don't want to show up in public. I hate it but to make thousands to walk on streets it takes a lot of money and effort and at the end not many people would show up.
I know I am ignoring the house representatives completely..but we make enough noise with senators it might just serve the purpose. Moreover, I think te house is not that against legal immigration.

especially the reasons you gave as to why this bill is interesting...this bill does not scream employment based immigration but as I see it it does have has employment based visa provisions along with much wider and extensive family based gc provisions ..also there is no mention of temporaray visas / temp workers with tis bill..no mention of legalizing illegals to legal ....it is focussed exclusively on reducing waiting time for GCs for folks who are in the queue with more emphasis on family based

So, if there are 400k pending applications and recapture can get us 215K, has anyone done some analysis on how the 215k will be divided among countries and categories?
Will this make EB2I current and EB3 I beyond say 2005?
I don't think any analysis is done. That is only going to divide the community.
Some would say preference be given to EB category benefiting EB2(I&C).
Some would say PD should be given preference predominantly benefiting EB3(I).
If they follow the current spill-over rules, as you are aware, EB category would be given preference.

Well, last year i was in a similar situation too ,actually worse than yours.My project ended in February '08.Then i went to India for 4 months. After i got back , my employer refused to pay for my health inssurance.I opted for COBRA and was paying 1200$ for my family , with my husband and child listed as dependants.I attended several interviews,while I was expecting my second child . Though its against the law, many were skeptical in employing me as a consultant during this time. I was very lucky to get a full time offer using my EAD, where my health coverage started after 60 days .All this time, without a project , i was paying through my nose for the health insurance using COBRA.
Ofcourse, i never bothered to inform my employer about my new employement.(Do i need to??)One fine day, i get an update on my H1 application , that the case has been reopened for review , and i get to know through my employer that he has CANCELLED my H1(got a 3 year extension based an approved I140).He did not give me chance to transfer it, inspite of me working rather slogging for 4 years , during which he shamelessly took the overtime money i earned as part of the billing.Though, i feel cheated,used etc etc.... but i did nothing. What could i have done?

I am talking about a person (like 485mbe - the one who has posted next to yr post) who has a PD of 2001 ..I am not saying that they should give Eb2's quota to EB3 ..but they should try to pull the category that is worst affected..or atleast give EB3 something ..
my question to you is ..say in the year 2010, would u support a situation where all categories are current or at 1 year difference ...while a particular category (eb3 I in this case) is at 2001 ??.. even if you do ..my feeling is that USCIS will try to pull EB3 - I (if something like above happens)..but then they are just a govt agency ..and in the end they are similar to govt agency in India ..only difference is that maybe little better

America isn't in the business of helping immigrants, it is in the business of helping itself. The fact is that it is a matter of irrelevance to the US whether it is EB2 or EB3 that is retrogressed. It is only interested in retaining the best labor force in the world. The moment the US gets more self sufficient in so-called "high skilled professionals", it will make the green card opening narrower, perhaps even get rid of the EB3 category altogether. And would that be fair or just? Yes. Why? Because America is looking out for its own interests, not that of the immigrants. It's what every government does and should do.

What do you mean by GC Journey? Do you mean the various USCIS stages (labor, I-140, I-485, ...) in the GC process? If yes, I can do that. However, I am not sure when it will get done. What is your deadline?

Assuming this congress and senate would favor CIR...
is CIR good for us. Last time around when we discussed we concluded that it would overwhelm USCIS with work and they would not be able to attend our application for a while. So i wonder tagging along with illegals is going to speed our cause?

I haven't applied for green card yet. Is IV only for GC purposes or it addresses other issues too which makes life of H1b holder hell?
Not sure why you would generalize all H1b holders as experiencing hell - I for one did not. Anyways if you take the time to browse the forums you will find the answer to your question.

Can you quote how this is addressing number 1 ?
AC 21 allows people to take on new positions as soon as they get H1 transfer receipt notice. How does this law address H1 transfer?
1) AC21 is used for H1B Transfer AND
2) AC21 is use for EAD (485 phase) Job change

I hope you are wrong about this. I do not see anything on the Approved AP that it should has been used for "humanitarian" purpose. It just mentions that the intention of AP is to allow the AOS applicant to return after temporary travel outside US. Correct me if I'm wrong.
You are absolutly incorrect. Unfortunatly most lawyer or their web sites do not explain the limitation of "parole". Because most of the CBP at POE are flexible; that does not mean that the law is flexible. This is what the instruction for AP in the form.
"Advance parole is an extraordinary measure used sparingly to bring an otherwise inadmissible alien to the United States for a temporary period of time due to a compelling emergency. Advance parole cannot be used to circumvent the normal visa issuing procedures and is not a means to bypass delays in visa issuance."

When there is a overflow, I strongly feel that it should flow to all the categories and that is called equality. Some inefficient people in Decision making authority at USCIS framed a rule on visa overflow and they are following it. If the rule is not much logical/ethical to most of the people, then anyone can voice their rights against it.
Just for example, a team consists of one project manager(EB1), two tech leads(EB2) and 6 Developers(EB3). The demand is based on no. of vacancies exists on the market, that means a lot of EB3, less EB2 and few EB1.
As per this rule, USCIS is not actually feeding the hungry.
Regarding the country quota, US is not favoring/helping the foreign countries by giving GC to those people from them. So, it makes no sense at all when it comes to immigrants but I can understand the bureaucracy behind it.
If they are implementing the country limit then it should be like 0.00001% of that country's population, I feel.

Therefore, more preference is given to those with a higher degree or more experience. What's unjust or unfair about that? The trick is to look at things from the American perspective and not from the immigrant perspective.

How do you think the passage of the DREAM ACT could impact our situation ? If they pass this, they would relief a sizeable portion of illegal immigrants to get amnesty through their children (few millions). I am just wondering whether the illegal alien supporters would lose steam to support CIR after this ? Ironically, they would get a sizeable amnesty, overhelm USCIS with millions of applicants and probably make the passage of a CIR bill more distant. I can't think of something less advantageous to us than this. I hope I am totally wrong.
What do you guys think ?

My G.C was approved on 08/20/2008 and they approved my EAD on 08/25/2008. I e-field EAD on 06/25/2008.
