I think your plan may work out just fine. I would make a couple of suggestions:
1. If you are taking LOA from original employer, for practical purposes (for USCIS), you are not employed with that employer any more (they go by pay stubs). But if doing so helps to avoid revocation of 140, go ahead and do it that way.
2. Because you will actually get your pay check from new employer, you are employed by them (and you will work on EAD with them, make sure that this is mentioned on your I-9 form). No matter how much ignorant your employer is, they will have to have I-9 on file and it must have your EAD (not H1).
3. After doing this, you will be on I 485 pending status (no longer on H status), and so make sure you have current EAD and AP all the time.
4. If something goes wrong with your I 485 (very unlikely); you will have to leave the country and enter back on H visa and work for H visa sponsoring employer (probably your old employer).
5. It is perfectly fine to not file AC21. AC21 is needed only if you do not plan to join original sponsoring employer after GC approval. However, if you do want to file AC21, you do not need much documentation from your new employer. It just needs the simple letter stating your job position as a "physician" and brief job duties (briefer the better!) and salary (should be proportional or higher). If you do not file AC21, you may just keep that documentation on file with your attorney (which I would do to be on safe side). The implication of having this is as follows:
--If you have this documentation (even if not filed with USCIS), at the time of approval of your GC you will have the option of just staying with new employer or going back to original employer.
--If you do not have this, you will have to go back to original employer after GC approval with a "good faith intention of permanent job".

We need to use the momentum of illegal issue to sneak in our provisions (which we already have with the advance degree provision, exception of spouses from cap,capture of unused visa numbers).

I read on post by a junior member where that person DID GET A CALL BACK FROM ONE OF THE SENETORS OFFICE AND THAT GUY COULD NOT ARTICULATE THE ISSUE WHEN THE SENETOR ASKED HIM IF THE ISSUE WE ABOUT INCREASING H1-B�S.
Exactly what happens when thousands of people contact senators instead of one fax from one organization with one point of contact just so that if some one actually calls back from the senator�s office we at least have some one who could explain the situation in a way that makes sense?
Also, I know how difficult it could be to get an amendment in just as well as you and I also know the fact that the real interest is in solving the illegal immigrant�s issue. Wait a minute here, if I was a cop, I would definitely judge this as DV. Unless, you absolutely had shut up to begin with. No chair, no drag, no nothing. which now has to be proved as misinterpretation.
And any offer that your lawyer brings you is trying to resolve the case, You are the one who should decide whether this case goes to trial or not.
Past peeing incidences, where the neighbours heard screams should be kept in mind.
And finally, take English lessons, dude, your written English too is very poor.
You can actually submit this as a proof that you were misinterpreted, if this goes to a Jury trial.
Also, please Delete any proof of the incidence, including the one posted here. No one shold be seeing the 100% truth, your 100% truth is scary.

I do agree an aggressive lawyer who knows the system would've put me in a much better situation.
After you wait for 7-8 years in your category for your visa your thougths will change. I have MS from an american university + work experience. Our lawyer decided to file EB3 in 2001, they convinced the company that EB3 is easier to get approved. i am still waiting for my GC, in the mean time i have gained a lot of experience, i am still an EB3 for USCIS. There are many in a similar position.
People talk about unethical practices etc. i feel that they ones who jumped the queue and used agressive lawyer already have their green cards. Most of my friends are already thinking about citizenship (and ROI after USC..that is a different forum :)).
Its people working in multinational companies who follow the law by the book are the ones who get screwed, its just my observation and opinion ..good or bad, i dont know...

I do not think any of you who is beating him down like this has any right in doing so. I bet that each and every one of you have done more mistakes than Mr.Sahaayam did. You just were never caught. Most likely this saga of retrogression will be decided in the next 2 to 3 months when Senate / House discuss the CIR. If by July end nothing happens, it will be a signal for us to leave. I know this will be a good news for some since the queue will get shorter, but who cares. This country "was" the best, but the next "best" country is likely to be from Asia. Remember, 245i cases were the NOT the same as the mexican illegal aliens that are being spoken of in relation to CIR .. lots of educated, legal H1-Bs lost their jobs (and their legal status) during the dot com burst of 2000 - 2002. Some of them stayed on even after going out of status, and then became eligible to file for GC under 245i.And needless to say, many more of those H1s came from India than mexico.
These people are illegal nevertheless, and I am ashamed that they are from my country.

Just because somebody's plans worked well , and some body's wife is happy staying home , all those GC chasers are now fools.
There are areas in USA where there is no appreciation at all in the real estate market , and not everybody is lucky enough to get the jobs immediately after coming on to the bench ., on H1B VISA.
In my opinion , 90% of the people on this forum have got all plans and ideas on what to do if there is no GC.But 100% of the peoples plans will be more successful ..if there is GC in hand.
