"Obviously the GOP had a big night tonight, maybe historical," said Craig Shirley, a Ronald Reagan biographer and longtime GOP adviser. "However, they ran largely as anti-Obama, which is not a governing philosophy. I say 'maybe historical' because the voters went for the Republicans for what they opposed and not what they proposed. History is made by what you do and not by what you won't do.
"Beginning on Wednesday, the GOP will have to decide what it stands for and what it will offer the American people."
This election is nonetheless significant for several reasons. First, the House of Representative has now switched hands between the two major parties three times in the last nine elections. This suggests that volatility in the House of Representatives is now a constant in political life. It is unlikely that in the near future either party will dominate the House the way the Democrats did for much of the last seven decades of the 20th Century. The Republicans may hold on to the House longer than the Democrats just have, but it will likely be only for a handful of terms, not a handful of decades as the Democrats did between 1955-1994.
Second, and more importantly, with control of the government now divided between the two parties, it will no longer be easy for the Republicans to blame the Democrats for the state of the economy. Nor will it be possible for the Republicans to simply say no to everything that is proposed in Washington. That strategy was useful when the Republicans were completely out of power, but the context has now changed.
This may lead to better bipartisan cooperation in Washington, but that is unlikely, particularly given the a real possibility that economic recovery will not happen by 2012, not because of the failure of politicians in Washington to address the problem, but because of the depth and seriousness of the problem itself. Given the difficulty of fixing the economy, even if both parties were willing to cooperate towards that end, the more potent strategy would be for both parties to increase the partisan rancor in Washington by blaming each other, accusing the other side of destroying the country and the like.
Dug the hole for 8 years, expect prosperity in 18 months!!!!

this is an open forum indeed, rarely do people ever get banned or posts deleted. however, with all rights come some duties and civility is foremost among them.
the person whose posts some are objecting to is not a moderator. he is expressing his own opinions. i'm quite amazed that he has been labeled one or put at par with moderators/administrators by some here.
this is indeed an information sharing forum although that's not all it is. i'm sorry the initial poster never got a reasonable reply. really should have.
as for contribution etc, iv or any moderator is not pushing anyone let alone rudely or being abusive for anything. but lest we all forget, this forum exists because this is a grassroots organization with a commitment to removing retrogression. if that goal gets lost in tourism to the forums, then the forums too will be lost too and very soon. just a gentle reminder for you oh so gentle folks!

You can read it 10 ways, but the CIS has only one interpretation(see bold below).
An un-adjudicated Form I-140 petition is not made valid merely through the act of filing the petition with USCIS or through the passage of 180 days. Rather, the petition must have been filed on behalf of an alien who was entitled to the employment-based classification at the time that the petition was filed, and therefore must be approved prior to a favorable determination of a �106(c) AC21 portability request.
I guess it is the same thing as earlier memo. They are saying that merely 180 days have passed since filing does not provide AC21 benefit. To determine AC21 benefit the petiton must be approved. So based on earlier memo, USCIS would see whther petiton can be approved. If yes then they will evaluate AC21. If not, then you got a problem.

I just called and the guy said he has the room ; he then started taking all my information and finally asked when I would arrive. I told him on 17th, 7:30am and he said " oh sorry we don't have any room, I thought you wanted it tomorrow"

Thought I should share my EB-3 (horror) story:
First initiated my RIR labor in 01/2002
PD: Aug 02,2002
RD: Sept 18, 2003
Approval: June 19 2007
I765 & 131 renewed 4 times.
Though I graduated with a Masters' degree from here back in '98, I was wrongly advised by a lawyer (who I unfortunately knew) who said I did'nt meet min. salary requirements and put me in EB-3 instead of EB-2 (though all my friends who graduated with me were in EB-2 and I knew they could'nt be making a whole lot more than I was). So if your lawyer wants to put you in EB-3 even though you're eligible for EB-2 change lawyers right away; It will mean a world of difference when things go bad. Chances are, the lawyer wants minimum paperwork & hassles to deal with. To add to bad luck, I had an Indian manager who refused to pay for my green card and even the ads for RIR labor, even though he got his green card paid for. Anyways priority dates were current for all categories back then (2002-3) just like it is today when they reclaimed unused numbers so this attorney had said EB3 vs EB2 won't be a problem and convinced me to go with EB3. This 'current' situation went on for some time (a year or so perhaps(?) to 2004 or 05; I do not remember) and then the DOS went and retrogressed EB3 back to 1999! During the year or two Priority Dates were current the INS (as it was called then) took their sweet time in processing cases progressing real slow. So when they were about 3-4 months away from processing my PD and I thought I was real close to 485 approval, the DOS did their thing and retrogressed dates all the way back to 1999 and has become current only now. It hit me with a gale force effect when it retrogressed.
It's almost like things swing like a pendulum between the two departments. If you're real lucky and time it right things can go smooth. If not yes you're screwed like I was and things can go bad one after the other. This time around I was almost sure the USCIS will take a go slow policy and wait for dates to retrogress once again like the last time. I was very surprised by the HUGE movements of 485 processing dates. Things are looking far better this time with these dates. Focus on getting your EAD and Advance paroles ASAP. I-140 premium processing will be worth it. Good luck to you all.

Just imagine what will happen to the market flooded with EADs. Job market for H1Bs will totally be down. No US companies will hire H1Bs if they get somebody with an EAD. Tonnes of Junior developers and S/W testers will in the market driving the billing rates down even further. It's better to pack up and leave. I have heard from one of the forums here that an estimated 500K people will file this month since all PDs are current. EB-3 mexico + phillipines togther alone will be close to 300K. God help the Job market.
Also minimum wait time will be 500K/140K ~ 4 yrs before they get to process your GC. Add to that the time for namecheck backlog 2+ yrs. So total 6+ yrs before getting GC........

E-filed on May 5th, FP on June 6th, no updates since. Concerned as I'm working on EAD and current one expires August 29th.

My lawyer is asking 350 for EAD and 500 for AP for each person excluding filing fees.Is it normal.or Can I go to another lawyer for EAD and AP who is cheaper than my company lawyer.
In general they are inclusive ie 485 + EAD + AP for primary is $1000 and for additional is $500 which is a standard.
